AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE
CITY OF CORPUS CHRISTI TO EXECUTE CONTRACTS BETWEEN
THE CITY OF CORPUS CHRISTI AND THE FOLLOWING:
1. H.E.R. DEVELOPMENT COMPANY, OWNER OF CASTLE
RIVER UNIT 2;
s 2. GUY ALEXANDER, WILLIAM D. WALLOCK AND PHILIP
M. WALLOCK, OWNERS OF CLUB ESTATES - SOUTH; AND
3. TUCKER PROPERTIES, A PARTNERSHIP, OWNERS OF
CLUB ESTATES UNIT 3,
A TRUE COPY OF EACH CONTRACT BEING ATTACHED HERETO
AND MADE A PART HEREOF, MARKED EXHIBITS "A ", "B ",
AND "C ", RESPECTIVELY, AND INCLUDING EXHIBITS
THERETO, AS THOUGH FULLY SET FORTH HEREIN, AFTER
DUE NOTICE AND HEARING, FOR THE ANNEXATION OF THREE
(3) TRACTS OF LAND, MORE PARTICULARLY DESCRIBED
HEREINAFTER BY METES AND BOUNDS; FINDING ALL OF
SAID LANDS TO LIE ENTIRELY WITHIN THE EXTRATERRI-
TORIAL JURISDICTION OF THE CITY OF CORPUS CHRISTI,
ADJOINING, CONTIGUOUS, AND ADJACENT THERETO; PROVIDING
FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
• WHEREAS, H.E.R. Development Company is the owner of Castle River
Unit 2; Guy Alexander, William D. Wallock and Philip M. Wallock are owners
of Club Estates - South; and Tucker Properties, a partnership, consisting
of John Tucker and Henry Tucker, partners, owners of Club Estates Unit 3,
in fee simple of the hereinafter particularly described tracts of land
adjoining, contiguous and adjacent to the City of Corpus Christi and wholly
within its extraterritorial jurisdiction; and
WHEREAS,_the said owners are desirous of contracting with the City
for the annexation of said territory to the City of Corpus Christi; and
WHEREAS, on July 19, 1978, a public hearing was duly held at the
Regular Meeting of the City Council, following publication of due notice
of said hearing in the official newspaper, pursuant to Art. 970a, V.A.C.S.,
Texas, as amended, for the consideration of institution of proceedings for
the annexation of defined areas wholly within the extraterritorial jurisdic-
tion of the City of Corpus Christi, more particularly described by metes
and bounds as hereinafter set forth, at which all interested persons were
afforded an opportunity to be heard, and by motion duly made, seconded and

WHEREAS, it has been determined by the City Council that the
territory within said tracts of land, now proposed to be annexed, abut and
are contiguous and adjacent to the City of Corpus Christi and constitute
lands and territories subject to contractual annexation as provided by the
City Charter Article I, Sec. 2c; and
WHEREAS, it has been determined that it would be advantageous
to the City and to its citizens and in the public interest to annex the
aforesaid lands and territory hereafter described:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager of the City of Corpus Christi
is hereby authorized and directed to execute contracts hetwPPn the rit.,
of Corpus Christi and N.E.R. Development Company, Guy Alexander, William D.
Wallock and Philip M. Wallock, and Tucker Properties, a partnership,
consisting of John Tucker and Henry Tucker, partners, a true copy of each
of said contracts being attached hereto and by this reference incorporated
herein for all purposes, including exhibits thereto, as though fully set
forth herein, for annexation of land and territory described as follows:
CASTLE RIVER UNIT 2
FIELDNOTES for 44.613 acres of land out of an 81.94 acre tract,
-and an 82.38 acre tract, both out of B.S. & F. Survey 419, Abstract
570 and both described by deed in Volume 589, Page 3, deed records
Of Nueces County, Texasa
BEGINNING at the East corner of Lot 25, Block 2, Gastle River
Unit It a map of which is recorded in Volume 42, page 78, map re-
cords of Nueces County, Texas for the Southeast corner of this sur-
vey;
THENCE with the North subdivision line of Castle River Unit 1,
North 60 °37'28" West 430.70 feet; North 72 °44'04" West 331.88 feet
to the point of curvature of .a circular curve to the right whose
radius bears North 72 °44104" West 1,090.00 feet and has a central
angle of 08 °42121 ", a radius of 2,090.00 feet, a tangent distance of
82.94 feet for an arc length of 165.57 feet;

Being a rectangular shaped tract of land out of Lots
17 and 32, Section 5, Flour Bluff and Encinal Farm and
Garden Tracts, as shown by map of record in Volume A,
pages 41, 42 and 43, Map Records, Nueces County, Texas,
and out of Lots 2 and 3, Block 11, Bohemian Colony Lands
as shown by map of record in Volume A, page 48, Map Records,
Nueces County, Texas, and more particularly described by
metes and bounds as follows:
Beginning at a point in the original southerly right -of-
way line of Snowgoose Road that bears S. 29° 02' W. a
distance of 20.0 feet from the east or northeast corner
of abovementioned Lot 17, Section 5, said point being
in the present city limit line, for the beginning point
of the tract of land herein described;
Thence continue S. 290 02' W. along the easterly boundary
lines of said Lots 17 and 32, a distance of 2,623.96 feet
to a point in the original centerline of County Road No. 19,
said point being the south or southeast corner of said
Lot 32;
Thence N. 61° 02' 50" W. along the centerline of said
County Road No. 19 with the southerly boundary line of
said Lot 32, pass the common west or.southwest corner of
said Lot 32 and the east or southeast corner of abovemen-

Being a rectangular shaped tract of land out of Lots 18,
19, 30 and 31, Section 5, Flour Bluff and Encinal Farm and
Garden Tracts, as shown by map of record in Volume A, pages
41, 42 and 43, Map Records, Nueces County, Texas, and more
particularly described by metes and bounds as follows:
Beginning at a point in the original southerly right -of -way
line of Snowgoose Road that bears S. 290 02' W. a distance
of 20.0 feet from the east or northeast corner of above -
mentioned Lot 19, Section 5, said point being in the present
city limit line, for the beginning point of the tract of
land herein described;

Thence continue S. 29° 02' W. along the easterly boundary
lines of said Lots 19 and 30, Section 5, a distance of
2,623.16 feet to a point in the original centerline of
County Road No. 19, said point being the south or southeast
corner of said Lot 30;
Thence N. 61° 02' 50" W. along the centerline of said County
Road No. 19, with the southerly boundary lines of said Lots
30 and 31; a distance of 1,322.10 feet to a point being the
west or southwest corner of said Lot 31;
Thence N. 290 02' E. along the westerly boundary line of
said Lots 31 and 18 a distance of 2,623.96 feet to a point
in the original southerly right -of -way line of abovementioned
Snowgoose Road, said point being in the present city limit
line;
Thence S. 610 00' 45" E. along the original southerly right -
of -way line of said Snowgoose Road with the present city
limit line a distance of 1,322.10 feet to the place of
beginning and containing 79.628 acres, more or less.
The hereinabove described land, subject to execution of said
contracts and adoption of annexation ordinance, will be admitted into the
City of Corpus Christi as an integral part thereof, said territory to be
a part of the City of Corpus Christi, subject to the general laws of the
State of Texas, the City Charter, and the ordinances, resolutions, motions
and regulations of the City of Corpus Christi, Texas; said described terri-
tory shall thereafter bear its proportionate share of the taxes levied by
the City and the inhabitants of such territory shall have the privileges
and be subject to all the duties of other inhabitants of the City of
Corpus Christi, Texas.
SECTION 2. If for any reason any section, paragraph, subdivi-
sion, clause, phrase, word, or provision of this ordinance shall-be held
invalid or unconstitutional by final judgment of a court of competent
jurisdiction it shall not affect any other section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance, for it is the definite
intent of this City Council that every section, paragraph, subdivision,
clause, phrase, word, or provision hereof be given full force and effect
for its purpose.
SECTION 3. The fact that the above named landowners desire to
immediately contract with the City for annexation and the City finds that
it is in the public interest to bring said territory into the corporate

limits as rapidly as possible creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordi-
nance or resolution shall be passed finally on the date of its introduction
but that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared such emergency and necessity
to exist, and having requested the suspension of the Charter rule and that
this ordinance be passed finally on the date of its introduction and take
effect and be in full force and effect from and after its passage, IT IS

THE STATE OF TEXAS
COUNTY OF NUECES
This Contract and Agreement made and entered into in duplicate
originals by and between H.E.R. Development Company
hereinafter called "Owner ", and the City of Corpus Christi, Texas, a home
rule city of more than 200,000 population, a municipal corporation and body
politic under the laws of the State of Texas, situated inINueces County,
Texas, hereinafter called "City ", for good and valuable consideration in
hand received by the parties respectively and upon the covenants and condi-
tions hereinafter stated.
W I T N E S S E T H
That Owner is owner in fee simple and of all existing rights,
titles and interests therein of all the following described property located
in Nueces County, Texas, adjacent to and adjoining the corporate limits of
the City of Corpus Christi, lying wholly within the extraterritorial juris-
diction of said City and,, in whole or in part, within three hundred (300)
feet of the City's present corporate limits, generally delineated on the
map attached hereto and marked Exhibit "A ", and being more particularly
described as follows, to -wit:

Christi, as amended, and as further prescribed by Ordinance No. 11139 of
the City of Corpus Christi.
That all of the above conditions shall be binding upon the
successors and assigns of the said Owner and each of them, and shall con-
stitute covenants running with the land.

in Nueces County,-Texas, adjacent to and adjoining the corporate limits of
the•City'of Corpus Christi, lying wholly within the extraterritorial juris-
diction of said City and,, in whole or in part, within three hundred (300)
feet of the City's present corporate limits, generally delineated on the
map attached hereto and marked Exhibit "A ", and being more particularly
described as follows, to -wit:
Being a rectangular shaped tract of land out of Lots 18,
19, 30 and 31, Section 5, Flour Bluff and Encinal Farm and
Garden Tracts, as shown by map of record in Volume A, pages
41, 42 and 43, Map Records, Nueces County, Texas, and more
particularly described by metes and bounds as follows:
Beginning at a point in the original southerly right -of -way
line of Snowgoose Road that bears S. 29° 02' W. a distance
of 20.0 feet from the east or northeast corner of above -
mentioned Lot 19, Section 5, said point being in the present
city limit line, for the beginning point of the tract of
land herein described;
Thence continue S. 29° 02' W. along the easterly boundary
lines of said Lots 19 and 30, Section 5, a distance of
2,623.16 feet to a point in the original centerline of
County Road No. 19, said point being the south or southeast
corner of said Lot 30;

Thence N. 610 02' 50" W. along the centerline of said County
Road No. 19, with the southerly boundary lines of said Lots
30 and 31, a distance of 1,322.10 feet to a point being the
west or southwest corner of said Lot 31;
Thence N. 29° 02' E. along the westerly boundary line of
said Lots 31 and 18 a distance of 2,623.96 feet to a point
in the original southerly right -of -way line of abovementioned
Snowgoose Road, said point being in the present city limit
line;
Thence S. 61° 00' 45" E. along the original southerly right -
of -way line of said Snowgoose Road with the present city
limit line a distance of 1,322.10 feet to the place of
beginning and containing 79.628 acres, more or less.
It is agreed by and between the parties hereto that the above
described land and territory shall be included within the corporate boundaries
of the City of Corpus Christi, Texas, and shall become a part thereof,
subject to the terms of Article I, Section 2, of the City Charter of Corpus
Christi, as amended, and as further prescribed by Ordinance No. 11139 of
the City of Corpus Christi. -
That all of the above conditions shall be binding upon the
successors and assigns of the said Owner and each of them, and shall con-
stitute covenants running with'the land.

a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
