AN ORDINANCE
ANNEXING THE FOLLOWING TRACTS OF LAND:
1. Castle River'Unit 2,
2. Club Estates South, and
3. Club Estates Unit 3,
IN NUECES COUNTY, TEXAS, MORE FULLY DESCRIBED HEREIN-
AFTER, PURSUANT TO ARTICLE 970a, V.A.C.S., TEXAS, AS
AMENDED, AND CITY CHARTER, ARTICLE I, SECTION 2(b);
PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY
WHEREAS, on the 19th day of July, 1978, a public hearing was
duly'held at the Regular Meeting of the City Council, following publication
of due notice of said hearing in the official newspaper pursuant to Article
970a, V.A.C,S., Texas, as amended, for the consideration of institution of
proceedings for the annexation of three tracts of land more fully described
hereinafter, Nueces County, Texas, at which all interested persons were
afforded an opportunity to be heard, and by motion duly made, seconded and
carried the said hearing was closed on July 19, 1978; and _
WHEREAS, owners of the above lands are desirous of contracting
with the Clty for the annexation of said territory to the City of Corpus
Christi; and
WHEREAS, it has been determined that it would be advantageous
to the City and to its citizens and in the public interest to annex the
aforesaid area hereinafter more fully described:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1, Three tracts of land as set forth in Exhibits
"A ", "B ", and "C" attached, being a copy of annexation contract between
the City of Corpus Christi and H.E.R. Development Company, Guy Alexander,
William D. Wallock, and Philip M. Wallock and Tucker Properties, respectively,
are hereby annexed, said tracts or parcels being more fully described as
follows;

CASTLE RIVER UNIT 2
FIELDNOTES for- 44_623 acres of land out of an 81.94 acre tract,
and an 82.38 acre tract, both out of B.S. & F. Survey 419, Abstract'
570 and both descilbed by deed in Volume 589, Page 3, deed records
of Nueces County, Texas:
BEGINNING at the East corner of Lot 25, Block 2, Castle River -_
Unit 2, a map of which is recorded in Volume 42, Page 78, map re-
cords of Nueces County, Texas for the Southeast- corner of this sur- -
Vey;
THENCE with the•North subdivision line of Castle River Unit 1,
North 60 °37'18" West 430.70 feet; North 72 °44104" West 332.88 feet
to the point of curvature of a circular curve to the right whose '
radius bears North 72 °44'04" West 1,090.00 feet and has a central
angle of 08 °42111 ", a radius of 1,090.00 feet, a tangent distance of '
82.94 feet for an arc 'length of 265.57 feet;
THENCE with said curve to the right 165.57 feet for a corner of
this survey;
CLUB ESTATES - SOUTH
Being a rectangular shaped tract of land out of Lots
17 and 32, Section 5, Flour Bluff and Encinal Farm and
Garden Tracts, as shown by map of record in Volume A,
pages 41, 42 and 43, Map Records, Nueces County, Texas,
and out of Lots 2 and 3, Block 11, Bohemian Colony Lands
as shown by map of record in Volume A, page 48, Map Records,
Nueces County, Texas, and more particularly described by
metes and bounds as follows:
Beginning at a point in the original southerly right -of-
way line of Snowgoose Road that bears S. 29° 02' W. a
distance of 20.0 feet from the east or northeast corner
of abovementioned Lot 17, Section 5, said point being
in the present city limit line, for the beginning point
of the tract of land herein described;
Thence continue S. 290 02' W. along the easterly boundary
lines of said Lots 17 and 32, a distance of 2,623.96 feet
to a point in the original centerline of County Road No. 19,
said point being the south or southeast corner of said
Lot 32; •
Thence N. 61° 02' 50" W. along the centerline of said
County Road No. 19 with the southerly boundary line of
said Lot 32, pass the common west or.southwest corner of
said Lot 32 and the east or southeast corner of abovemen-
tioned Lot 3, Black 11, Bohemian Colony Lands, at 662.76
feet, in all a distance of 682.76 feet to the point of
intersection with a southwest extension of the original
westerly right -of -way line of Everhart Road;
Thence N. 290 04' 20" E., at 20.0 feet pass the point of
intersection of the original northerly right -of -way
line of said County Road No. 19 and the original westerly
right -of -way line of said Everhart Road, in all a distance
of 2,624.35 feet to the point of intersection with a
westerly extension of abovementioned original southerly
right -of -way of Snowgoose Road and a corner in the present

,line, pass the common easterly boundary line of said Lot 2,
Block 11, Bohemian Colony Lands and the westerly boundary
line of said Lot 17 at 20.0 feet, pass the point of inter-
section of the original easterly right -of -way line of said.
Everhart Road and the original southerly right -of -way line
of said Snowgoose Road at 40.0 feet, in all a distance of
681.0 feet to the place of beginning and containing 41.080
acres, more or less.

Being a rectangular shaped tract of land out of Lots 18,
19, 30 and 31, Section, 5, Flour Bluff and Encinal Farm and
Garden Tracts, as shown by map of record in Volume A, pages
41, 42 and 43, Map Records, Nueces County, Texas, and more
particularly described by metes and bounds as follows:
Beginning at a point in the original southerly right -of -way
line of Snowgoose Road that bears S. 29° 02' W. a distance
of 20.0 feet from the east or northeast corner of above -
mentioned Lot 19, Section 5, said point being in the present
city limit line, for the beginning point of the tract of
land herein described;'
Thence continue S. 290 02• W. along the easterly boundary
lines of said Lots 19 and 30, Section 5, a distance of
2,623.16 feet to a point in the original centerline of
County Road No. 19, said point being the south or southeast
corner of said Lot 30;
Thence N. 61° 02' 50" W. along the centerline of said County
Road No. 19, with the southerly boundary lines of said Lots
30 and 31; a distance of 1,322.10 feet to a point being the
west or southwest corner of said Lot 31;
Thence N. 29° 02' E. along the westerly boundary line of
said Lots 31 and 18 a distance of 2,623.96 feet to a point
in the original southerly right -of -way line of abovementioned
Snowgoose Road, said point being in the present city limit
line;
Thence S. 61° 00' 45" E. along the original southerly right -
of -way line of said Snowgoose Road with the present city
limit line a distance of 1,322.10 feet to the place of
beginning and containing 79.628 acres, more or less.
The above described areas shall hereafter be a part of the City of Corpus
Christi, Texas, and shall be subject to the general laws of the State of
Texas, the City Charter of the City of Corpus Christi and the ordinances,
resolutions, laws, rules and regulations of the City of Corpus Christi,
to all intents and purposes as the present City of Corpus Christi is so
subject, and subject to all the rights, privileges and burdens thereof.
SECTION. If for any reason any section, paragraph, subdivision,

clause, phrase, word, or provision of this ordinance shall be held invalid
or unconstitutional by final jdugment of a court of competent jurisdiction,
it shall not affect any other section, paragraph, subdivision, clause, phrase,
word, or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase,
Nord, or provision hereof be given full force and effect for its purpose.
SECTION 3. The necessity to immediately annex to the City of
Corpus Christi, the aforesaid lands and to declare that they shall hereafter
be a part of the corporate limits of the City of Corpus Christi, creates
a public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, having requested the suspen-
sion of the Charter rule and that this ordinance take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO

This Contract and Agreement made and entered into in duplicate
originals by and between H.E.R. Development Company
,
hereinafter called "Owner ", and the City of Corpus Christi, Texas, a home
rule city of more than 200,000 population, a municipal corporation and body
politic under the laws of the State of Texas, situated in Nueces County,
Texas, hereinafter called "City ", for good and valuable consideration in
hand received by the parties respectively and upon the covenants and condi-
tibns hereinafter stated.
WITNESSETH:
That Owner i5 owner in fee simple and of all existing rights,
titles and interests therein of all the following described property located
in Nueces County, Texas, adjacent to and adjoining the corporate limits of
the City of Corpus Christi, lying wholly within the extraterritorial juris-
diction of said City and,: in whole or in part, within three hundred (300)
feet of the City's present corporate limits, generally delineated on the
map attached hereto and marked Exhibit "A ", and being more particularly
described as follows, to -wit:

It is agreed by and between the parties hereto that the above
described land and territory shall be included within the corporate boundaries
of the City of Corpus Christi, Texas, and shall become a part thereof,
subject to the terms of Article I, Section 2, of the City Charter of Corpus
Christi, as amended, and as further prescribed by Ordinance No. 11139 of
the City of Corpus Christi.
That all of the above conditions shall be binding upon the
successors and assigns of the said Owner and each of them, and shall con-
stitute covenants running with the land.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
