HomeMy WebLinkAbout14414 ORD - 08/02/1978AN ORDINANCE CLOSING A PORTION OF STREETS AS SHOWN ON "MAP OF PORTION OF THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS SHOWING LANDS RECLAIMED BY THE BAYFRONT PROTECTION WORK" AS RECORDED IN VOL. 9, PAGES 38 THRU 41, MAP RECORDS OF NUECES COUNTY, TEXAS, DESCRIBED AS FOLLOWS, AND DECLARING AN EMERGENCY. 1. THAT PORTION OF NORTH WATER STREET FROM THE NORTH RIGHT -OF -WAY LINE OF HUGHES STREET TO THE NORTH RIGHT -OF -WAY LINE OF HIRSCH STREET, AND; g, b 2. THAT PORTION OF BREWSTER STREET FROM THE EAST 4 41. RIGHT -OF -WAY LINE OF NORTH CHAPARRAL STREET TO THE WEST RIGHT -OF -WAY LINE OF THE EAST LANE OF NORTH SHORELINE BOULEVARD AND; 3. THAT PORTION OF THE WEST DRIVE (60 FEET WIDE) OF NORTH SHORELINE BOULEVARD FROM THE NORTH RIGHT -OF -WAY LINE OF HUGHES STREET TO THE SOUTH RIGHT -OF -WAY LINE OF BREWSTER STREET. WHEREAS, notice of the time and place for holding a hearing concerning the closing of a portion of the hereinafter described streets was given by publication and mailed to the last known address of the owners of property abutting said streets and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Meeting of the City Council of the City of Corpus Christi on Wednesday, July 26, 1978, , in accordance with the provisions of the City Charter; and; WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the portion of streets within the limits hereinafter described, for use as public streets, subject to certain conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the portions of streets described as follows be and the same are hereby closed for use as. public streets and abandoned to the owner of the abutting properties, the same being the City of Corpus Christi, said portions of streets being as follows: n 1. THAT PORTION OF NORTH WATER STREET FROM THE- Iy O� NORTH RIGHT -OF -WAY LINE OF HUGHES STREET TO ��„ L , THE NORTH RIGHT -OF -WAY LINE OF HIRSCH STREET; AND; r 14414 2. THAT PORTION OF BREWSTER STREET FROM THE EAST RIGHT -OF -WAY LINE OF NORTH CHAPARRAL STREET TO THE WEST RIGHT- OF -14AY LINE OF THE EAST LANE OF NORTH SHORELINE BOULEVARD AND; 3. THAT PORTION OF THE WEST DRIVE (60 FEET WIDE) OF NORTH SHORELINE BOULEVARD FROM THE NORTH RIGHT -OF -WAY LINE OF HUGHES STREET TO THE SOUTH RIGHT -OF -WAY LINE OF BREWSTER STREET; said streets being shown as public streets on "Map of Portion of the City of Corpus Christi, Nueces County, Texas, Showing Lands Reclaimed by the Bayfront Protection Work" as recorded in Vol. 9, Pages 38 thru 41, Map Records of Nueces County, Texas. Portions of said streets also being shown on a plat titled "Plan of the City of Corpus Christi ", in Book A-, Pages 2 and 3 of the Map Records of Nueces County, Texas. Said closure of herein described streets is hereby excepted by the retainage of a utility easement in North Water Street from the north right -of -way line of Hirsch to the north right -of -way line of Brewster, and the retainage of a utility easement in Brewster Street from the east right -of -way line of North Chaparral Street to the west right -of -way line of North Water Street. Provided however that the closing of the hereinabove described streets shall become effective only when said streets are barricaded by ` the abutting property owner, the City of Corpus Christi. SECTION 2. If for any reason any section, paragraph, sub- division, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect. SECTION 3. The fact that the public convenience and necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction, but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take i effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED THIS THE N� day of A U(,(15 T- , 1978.
