AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO ENTER INTO A
CONTRACT WITH DAVID A. BOLIN FOR THE RENTAL OF
53 PARKING SPACES FOR A MONTH -TO -MONTH PERIOD
BEGINNING AUGUST 10, 1978, AS MORE FULLY SET
FORTH IN THE CONTRACT, A SUBSTANTIAL COPY OF WHICH IS
ATTACHED HERETO AND MADE A PART HEREOF, MARKED
EXHIBIT "A "; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
and directed to enter into a contract with David A. Bolin for the rental of
53 parking spaces for a month -to -month period beginning August 10, 1978
all as more fully set forth in the contract, a substantial copy of which is
attached hereto, made a part hereof, and marked Exhibit "A ".
SECTION 2. That the necessity to immediately enter into the
aforementioned contract creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction but that
such ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor having declared such emergency and necessity to
exist, and having requested the suspension of the Charter rule and that this
ordinance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the �9 ay of August, 1978.

David A. Bolin, P. 0. Box 1, Everett, Washington,,98206, herein-
after called "Lessor ", does hereby lease to the City of Corpus Christi,
hereinafter called "Lessee ", acting by and through its duly authorized City
Manager, fifty -three (53) parking spaces in his parking garage located on
the northwest corner of Water and Lawrence Streets, the parking garage
being located on the east two - thirds (2/3) of Lots 1, 2 and 3, Block 3,
Beach Addition.
1, The property hereby leased includes 18 spaces on the third
level, southside, numbered 301 -318 inclusive, 17 spaces on the fourth level,
nouthside numbered 401 -417 inclusive, and 18 spaces on the fifth level,
southside, numbered 501 -518 inclusive, totaling 53 spaces.
2. The rental for said 53 parking spaces is at the rate of
fifteen dollars ($15) per month per space and totals Seven Hundred Ninety -
five Dollars ($795) per month, payable on or before the first day of each
calendar month, but not later than'the fifteenth day of the calendar month
for which payment is due. Payment shall be prorated on the basis of a 30 -day
month for any partial month of occupancy.
3. The term of this lease is on a month -to -month basis until
cancelled by either Lessor,or Lessee upon giving 30 days notice in writing.
_ 4. The City hereby releases Lessor for liability for damage or
injury to City of Corpus Christi vehicles, City employees and their per-
sonally owned vehicles while in the above described parking building.

TO THE MEMBERS OF THE CITY COUNCIL
Corpus'Christi, Texas.
For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
