AN ORDINANCE
CLOSING AND ABANDONING A PORTION OF THE 1.5 FEET ALONG
THE EAST SIDE OF THE EXISTING•7.5 -FOOT UTILITY EASEMENT
IN LOT 15, BLOCK 6, RIDGEWOOD UNIT 1, RECORDED IN VOL.
40, PAGES 92 -93, MAP RECORDS OF NUECES COUNTY, TEXAS;
PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, there exists a certain 7.5 -foot utility easement in
Lot 15, Block 6, Ridgewood Unit 1, recorded in Volume 40, pages 92 -93,
Map Records of Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advan-
tageous to the City of Corpus Christi to abandon a portion of the 1.5 feet
along the east side of the existing 7.5 -foot utility easement aforesaid:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the portion of the 1.5 feet along the east side
of the existing 7.5 -foot utility easement of Lot 15, Block 6, Ridgewood
Unit 1, recorded in Volume 40, pages 92 -93, Map Records of Nueces County,
Texas, more fully described hereinafter, be and the same is hereby closed
for public use and every municipal purpose, and abandoned to the owners
of the abutting property in accordance with the laws of the State of a
Texas, and for the service and interest of the inhabitants of the City
of Corpus Christi, Texas, said easement to be abandoned being more fully
described as follows:
BEGINNING at the Southwest corner of an existing brick house
for the Southwest corner of this description, from which corner the
Southwest corner of said Lot 15 bears North 81 153'53" West 6.00
feet to a point on the West line of Lot 15 and with said West line,
South 06 °37'38" West 36.20 feet;
THENCE North 08 °06'07" East, along the outside West facing of
said existing house, 50.50 feet to the Northwest corner of said
house for the Northwest corner of this description;
THENCE South 81 °53153" East, along the outside North facing of
said house, 0,20 feet to a point on the East line of said 7.50 foot
wide utility easement for the Northeast corner of this description;
THENCE South 06 °37138" West, along the East line of said 7.50
foot wide utility easement, parallel with the West boundary line of
said Lot 15 thereof and 7.5 feet distant therefrom, measured at
right angles thereto, 50.52 feet to a point on the outside South
facing of said house for the Southeast corner of this description;
THENCE North 81 °53153" West, along said outside South facing,
1.50 feet to the POINT OF BEGINNING, containing 43.0 s feet
of land, more or less. C U

SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction
it shall not affect any other section, paragraph, subdivision, clause,
phrase, word, or provision of this ordinance,for it is the definite intent
of this City Council that every section, paragraph, subdivision, clause,
phrase, word or provision hereof be given full force and effect for its `
purpose.
SECTION 3. The fact that the public convenience and necessity
would be better served by the closing of the aforesaid-easement creates
a public emergency and an imperative public necessity requiring the suspen-
sion of the Charter rule that no ordinance or resolution shall be passed
finally on the date of its introduction but that such ordinance or resolu-
tion shall be read at three several meetings of the City Council, and the
Mayor having declared such emergency and necessity to exist, having requested
the suspension of the Charter rule and that this ordinance take effect
and be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the_ cl M day of August, 1978.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
