AN ORDINANCE AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR A GRANT ON BEHALF OF NUECES COUNTY TO THE COASTAL BEND COUNCIL OF GOVERNMENTS FOR THE TITLE V MULTI- PURPOSE SENIOR CENTERS PROVIDING FOR FUNDING IN THE AMOUNT OF $6,075 FOR THE PURPOSE OF RENOVATION OF ROBSTOWN CENTER, ALL AS IS MORE FULLY SET OUT IN THE APPLICATION, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL RELATED CONTRACTS AND OTHER DOCUMENTS NECESSARY IN THE IMPLE- MENTATION OF THIS PROGRAM; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to submit an application to the Coastal Bend Council of Governments on behalf of Nueces County for the Title V Multipurpose Senior Centers, providing for fundingih;�the amount of $6,075 for the purpose of renovation of the proposed site of Robstown Center, all as is more fully set out in the application, a substantial copy of which is attached hereto -and made a part hereof, marked Exhibit "A ". SECTION 2. That the City Manager is authorized to execute all related contracts and documents necessary in the implementation of the aforesaid program on behalf of Nueces County. SECTION 3. The necessity to authorize submission of the aforementioned application for a grant for the renovation of the proposed site of Robstown Center at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance-or resolution shall be passed finally on the date of its intorduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and C OFILMED JUL 0 8 1900 14449 � N effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /day of August, 1978. This has been the location of the Center for a year and a half. Previously, Senior Community Services operated two small centers in Robstown. The Tampico Res- taurant location represents a combining of the two small meal sites and a consolidation of services. The Robstown Center offers a noonday meal, recreational services which include dancing, sewing, pool, crocheting, bingo and excursions. So- cial services such as outreach, escort, health and welfare counseling and blood pressure screening are also offered. Transportation serv- ives are coordinated and provided to senior citizens in Robstown and 'Bishop area from the Center. The Center is rented from a private individual for $175.00 per month plus utilities. The building which includes a center and a kitchen and office space is approximately 2500 square feet. Recently, the Nueces County Community Action Agency has invited Senior Community Services to-locate the Robstown Center in the old Nueces County building. The building is now leased to the Community Action Agency by the County. The Community Action Agency has plans to convert the building into multipurpose use. The Coastal Bend Legal Aid presently has space in the building. Other agencies, including Senior Community Services, also plan to locate in spaces adjacent to the Legal Aid offices. A fee will not o be charged for rental of the space. Utilities will be prorated to all a- gencies in the building. The space to be assigned for the Robstown Center is approximately 1200 square feet which will include a center and office space. The space is now being used for storage space and must be prepared for use as a senior center. The following preparation must be made in order to ready the space: (1) Installation of central air conditioning and central heat (includes duct work, grills, heating /cooling systems, high - voltage electrical wiring and all labor) $4000 (2) Installation of 1/8" commercial floor tile, installation complete 1100- (3) Installation of solid core door with screened outside doors and deadbolt lock 700 (4) Installation of screen door on front door opening 75 (5) Installation of door between office space and center 50 (6) Installation of plastic tube covers over fluorescent lights 150 2 0 AN INTERAGENCY AGREDIENT AWARDING GRANT FINDS FOR THE ACQUISITION, RENOVATION, ALTERATION OR -FURNISHING OF A SENIOR CENTER FACILITY THIS AGREEMENT is between City of Corpus Christi called ::Contractor" and the Coastal Bend Council of Governments, called "Agency ", considering that the area Agency desires to engage the Contractor to render services to elderly persons in the designated service area under the approved Area Plan for Programs on Aging which is partially financed by a grant from the Office of the Governor's Committee on Aging under the Federal Older Americans Act of 1965, as amended, and par- tially financed by Contractor; THEREFORE, the two parties do-mutually agree as follows: 1. Contract Period. Contractor shall provide ser- vices for the contract period be .ginnin .g. August 1, 1978 and ending May 31, 1979 2. Service Area. Agency agrees to reimburse Con- tractor a sun not to exceed $ for services provided. For the purposes of clarifying the meaning of services described in the approved project applica- tion, the following definitions, as provided in tine Fedcral Regulation ('title 45, Chapter XIII, Part 1326) implementing Title V of the Older Americans Act of 196S, as amended, (Public Law 93 -29), are made a part of this Contract: a. •Senior Center means a community facility for the organization an provision of a broad spectrum of services, which may include -the provision of health, social and educa- tional services and provision of facilities for recreational activities for older persons. b. Altering and Renovat- means that activity which allows for expansion of existing facilities up to two times the square footage of the original facility. C. Structural change applies to changes made to a building in the course or altering or renovating- d. Equipment is an article or property pro- cured or fabricate w3 w`ich nt is complete in itself, is of a dur- able nature, and has an expected service life of more than one year and an acquisition cost of $300 or more per unit. 6. Contractor: a. shall comply with the requirements of the Davis -Bacon Act and other mandatory federal labor standards assuring that H.E.W. requirements regarding labor standards and Equal Employment Opportunity be followed; b. shall observe federal and state regulations and requirements as specified by Agency and the Governor's Committee on Aging; C. has, or gill secure at his own expense, all personnel required to perform the services to be provided under this Contract. Such personnel shall not be employees Of or have any contractual relationship with Agency. d'. shall maintain and make available to Agency or their agents at reasonable times and for reasonable periods those books, records, and supporting documents kept current by Contractor and its Sub - Contractors, if any, pertaining to this project for purposes of inspection, monitoring, auditing, or evaluating. e. shall furnish Agency with fiscal reports and an itemization of expenditures each month in a format pre- scribed by Agency. Such reports shall be furnished on or be- fore the 15th day following the end of the billing month. f. agrees to provide matching funds in the amount indicated in the approved Plan of Operation (Lxhihit "A ") and to document same in the monthly billing for cost reimbursement. g. shall identify all equipment purchased with funds allocated to Contractor under such contract by appropriate tags or labels affixed thereto, and maintain a current inventory of such equipment. Contractor also assumes responsibility for the protection of such equipment. Ownership and'disposi- tion of equipment will be in accordance with state regulations. h. shall' maintain current information with—re- spect to the opportunities and services available to older per - sons,and employ a specially trained staff, including bilingual individuals as appropriate, to inform older persons of the opportunities and services which are available, and assist them to take advantage of such opportunities and services. i. shall maintain records of usage of services offered and demand for services unavailable and shall report same to the Agency. j. shall maintain the confidentiality of re- cords relating to persons served in accordance with the appli- cable Federal Law, being Section 402 (A)(9) of Title IV, Part A of the Federal Social Security Act, as amended, and the Rules and Regulations issued pursuant thereto as well as the applicable State Law, being Section 33 of Article 695C, Vernon's Texas Civil Statutes, as amended, and the Rules and Regulations issued pursuant thereto. 7. Agency shall: a. convey information on federal and state regu- lations and guidelines implementing the Older Americans Act; b. monitor program operations providing tech- nical assistance as "mutually agreed upon; 'c.' assist in securing and making available information on services and resources necessary to provide information and referral services and will promote interagency cooperation making services accessible to the elderly; d. cbnduct "analyses of client usage and ser- vice demand data provided by the Contractor; and e. handle administrative details and cost reim- bursements in an expeditious manner. 8. General Provisions: a. Supporting fiscal documents will be retained to assure that claims for Federal matching funds are in accord 3 with applicable Federal requirements. Said documents shall be maintained and retained by Contractor and all Sub - Contractors, if any, for a period of three years after the end of the Federal Fiscal Year if audit by or on behalf of the Agency has occurred by that time. If audit has not occurred, the documents must be retained until audit or until five years following the end of the Federal Fiscal Year, whichever is earlier. In all cases, documents shall be retained until the resolution of audit questions. Contractor agrees to reimburse the Agency for any and all project costs determined by audit or other- wise during this project period or at some later date to be ineligible expenditures. b. Contractor will not discriminate against any employee or person seeking employment with regard to race, color, religion, sex, national origin, or age. Contractor shall take affirmative action to ensure that applicants are employed and that employees are treated during employment, without regard to race, color, religion, sex, national origin, or age. Such action shall include, but not be limited to the following: employment, upgrading, demotions, or transfers, recruitment or advertising, layoffs, or terminations, rates of pay or other forms of compensation; selection for training including apprenticeship; and participation in recreational and educational activities.' C. Contractor shall keep such records and sub- mit such reports concerning.-th'e racial and ethnic origin of applicants for employment and employees as may be requested by the Agency, as may be required by law. d. Equal opportunity will be provided to elder]), persons seeking employment or services under this contract . without regard to race, color, -religion, sex or national origin. C. Changes; which may, from time to time, be required in the scope---of services of the Contract, including any increase or decrease in the amount of compensation, which are mutually agreed upon by and between Agency and Contractor, shall be incorporated by writt -en amendments to this Contract. f. None of the work or services covered by this Contract shall be sub- contracted without the prior written ap- proval of Agency. 9. Termination. a. Termination of Contract for Cause. In the event that Contractor fails to provide services in accordance with the approved Plan of Operation and in accordance with the provisions of this contract, Agency may, upon written notice to Contractor, terminate the whole or any part of this contract, and such termination shall not be an exclusive remedy, but shall be in addition to any other rights provided by law or under this contract. b. Termination of Contract without Cause. In the event that federal or state laws or other requirements should be amended or judicially interpreted so as to render continued fulfillment of this contract, on the part of either party, substantially unreasonable or impossible, or if the par- ties should be unable to agree upon any amendment which would therefore be needed to enable the substantial continuation of the-services contemplated herein, then, and in that event, the parties shall be discharged from any further obligations created under the terms of this contract, except for the equi- table settlement of the respective accrued interests or obliga- tions incurred up to the date of termination. c. Termination of Contract by Mutual Consent. This contract may be cancelled by mutual consent; however, if such .mutual consent cannot be attained, than, in that event, either party to this' contract may consider it to be cancelled by the giving of sixty ,(60) days notice in writing to the other party and this contract shall thereupon be cancelled upon the expiration of sixty (60) days notice period. 1'0. No officer; member or employee of the Area Agency and no member's of its governing body, and no other public official of•tho'governing body of the locality or localities in which the iiroject is situated or being carried out who exercises any functions or responsibilities in the review or approval of the undertaking or carrying out of this project, shall participate in any decision relating to this contract which affects his or her personal interest or have :iny personal or pecuinary"intere"st, direct or indirect, in this contract. 11. Contractor Liability. Contractor is an inde- pendent contractor an Agency shall have no liability for the negligent acts or omissions of the Contractor's employees. Contractor agrees to hold Agency harmless for clairis against Agency arising out of such acts by Contractor, its employees, its sub- contractors, if any, or its sub- contractors' employees.
