HomeMy WebLinkAbout14457 ORD - 08/16/1978JKH:hb:8 /16/78 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF Rill D_ ST. CLAIR BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT A, 53.79 ACRES AND TRACT B, 8.37 ACRES, LOTS 2,3,8,AND 9. BLOCK 2, J. C. RUSSELL FARM BLOCKS , SITUATED IN THE CITY OF CORPUS CHRISTIA NUECES COUNTY, - TEXAS, FROM "F -R "'FARM - RURAL - DISTRICT -TO "I =2" LIGHT INDUSTRIAL DISTRICT, ON TRACT A; AND FROM "F -R" FARM - RURAL DISTRICT AND ON NE -FAMIL DEWLLIN DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT ON TRACT B; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Bill D. St. Clair for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday August 16, 1978 . at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would beat serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. SECTION 2. That the zoning on Tract A, 53.79 acres and Tract B, 8.37 acres out of Lots 2,3,8, and 9, Block 2, J. C. Russell Farm Blocks, situated in the City of Corpus Christi, Nueces County, Texas, and more par- ticularly described as follows: TRACT A FIELDNOTES for 53.792 acres of land out of Lots 2, 3, 8 and 9, Block 2, J. C. Russell Farm Blocks, a map of which is recorded in Volume 28, Pages 58 and 59, Map Records of Nueces County, Texas. BEGINNING at a point on the east right -of -way line of Heinsohn Road, same being the common northwest corner of Lot 1, said Block 2, and the southwest corner of said Lot 2, for the southwest corner and POINT OF BEGINNING of this tract; THENCE North, along said east right -of -way line, 1026.00 feet to the common corner of said Lot 3 and Lot 4, said Block 2, for the northwest corner of this tract; THENCE East along the common boundary line of said Lots 3 and 4, and the common boundary line of said Lot 7 and 8, 2273.79 feet for the northeast corner of this tract; THENCE South 1026.00 feet to a point on the common boundary line of said Lot 9 and 10, and Lots 1 and 2 for the southeast corner of this tract; THENCE West, along said common boundary line, 2273.79 feet to the POINT OF BEGINNING. - TRACT -B FIELDNOTES for 8.369 acres of land out of Lots 8 and 9, Block 2, J_ C. Russell Farm Blocks, a map of which is recorded in Volume 28, Pages 58 and 59, Map Records of Nueces County, Texas. BEGINNING at a point on the west right -of -way line of North Padre Island Drive (S.H. No. 358), same being the common corner of Lot 7, said Block 2, and said Lot 8, for the northeast corner of this tract and the POINT OF BEGINNING; THENCE South, along said west right -of -way line, 443.69 feet to the point of curvature of a circular curve to the left having a central angle of 5 146133" and a radius of 1970.08 feet fora corner of this tract; - THENCE along said west right -of -way line and the arc of said curve to the left a distance of 198.59 feet to the point of tangency; THENCE South, along said west right -of -way line, 292.46 feet for an inside corner of this tract; THENCE South 12 °58'00" East, along said west right -of -way line, 94.00 feet to the common corner of said Lots 9 and 10, for the southeast corner of this tract; THENCE Nest, along-said common boundary line of Lots 9 and 10, 381.10 feet for the southwest corner of this tract; THENCE North 1026.00 feet to a point on the common boundary line of said Lots 9 and 10 for the northwest corner of this tract; THENCE East, along said common boundary line, 350.00 feet to the POINT OF BEGINNING. .v -•+� be and the same is hereby changed from "F -R" farm -Rural District to "I -2" Light Industrial District on Tract A; and from "F -R" Farm -Rural District and "R -1B" One- family Dwelling District to "B -4" General Business District on Tract B. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Nap of the. City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and W"Aj it s passage, IT IS ACCORDINGLY SO ORDAINED; this the day of 19,�� ATTEST Citq'Secretary AP OVED: �J DAY 0 EGG ,19.70 City Attorn i Corpus Christi, Te ` day of 19_� TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
