MIMMS, dba ALPHA RENTAL PROPERTIES, DEVELOPER OF LAKEVIEW ACRES SUBDIVISION, WHEREBY THE CITY WILL PARTICIPATE IN THE OVERSIZE / OVERDEPTH OF THE SANITARY SEWER ACROSS LOT 8, BLOCK 1, LAKEVIEW ACRES SUBDIVISION, TO LAKEVIEW DRIVE, A SUBSTANTIAL COPY OF SAID AGREEMENT BEING ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; APPROPRIATING $4,515 OUT OF THE NO. 250 SANITARY SEWER BOND FUND FOR PROJECT NO. 250 -77 -15.4, LAKEVIEW ACRES SUBDIVISION, OVERSIZE/ OVERDEPTH OF SANITARY SEWER LINE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with Ms. Olene V. Mimms, dba Alpha Rental Properties, developer of Lakeview Acres Subdivision, whereby the City will participate in the oversize /overdepth of the sanitary sewer across Lot 8, Block 1, Lakeview Acres Subdivision, to Lakeview Drive, a substantial copy of said agreement being attached hereto, marked Exhibit "A ", and made a part hereof. SECTION 2. That there is hereby appropriated $4,515 out of the No. 250 Sanitary Sewer Bond Fund for the aforesaid Lakeview Acres Subdivision f Oversize /Overdepth of Sanitary Sewer Line, Project No. 250 -77 -15.4. SECTION 3. The necessity to authorize the aforesaid agreement and to provide sufficient funds to enable the project to be completed at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction, but that such ordinance or resolution shall be read at three several meetings of the City Council, andlhe Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the�/day of Se mber, 1978. By �0��9ao Nstant City Attorney 14489 �g� AGREEMENT THE STATE OF TEXAS COUNTY OF NUECES j This agreement is authorized by Ordinance No. and is entered into between the City of Corpus Christi, Texas, hereinafter called "City", and Olene V. Mimms, Developer of Lakeview Acres, doing business as Alpha Rental Properties, being referred to as "Developer ", and pertains to the City's share of•the,cost for improvements when City participation is set forth in the Platting Ordinance and for improvements required by the City over and above those set forth in the Platting Ordinance in the development and resubdivision of the portion of Lakeview Acres herein described. NOW, THEREFORE, the City and the Developer agree as follows: 1. The Developer will construct a 10" vitrified clay pipe from the existing Lexington Park system across Lots 8 -A, 8 -B and 8 -C, Block 1, Lakeview Acres Subdivision to Lakeview Drive. This construction will be contracted for and financed by the Developer. The attached Exhibit "A" shows the location and extent of the work. 2. The City agrees to reimburse the Developer as its oversize- overdepth share for the cost of the above stated construction, including 7W. engineering, the sum of Four Thousand Five Hundred Fifteen and No /100 Dollars ($4,515.00). See attached Exhibit "B" for cost basis for this agreement. Such reimbursement will be made by the City to the Developer upon completion and acceptance of the improvements by the City. (Refer Urban Engineering Job No. 14493). 3. The Developer agrees to indemnify the City against any claims arising as a result of the project. V;4. 4. This agreement shall be executed in duplicate, both of which shall be coasidered one instrument. When both of the duplicates have been executed by the City; and at least one duplicate has been executed by the Developer, this agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors, and assigns.
