That the City Manager be and he is hereby authorized to execute Change Order No. 2 to the contract with Maverick Construction Company for improvements to the Hearn Road Drainage Ditch, a substantial copy of which is attached hereto, marked Exhibit "A", and made a part hereof. SECTION 2. That there is hereby appropriated the sum of $4,300 out of the No. 295 Storm Sewer Bond Fund for Project No. 295- 70 -70, for improvements to the Hearn Road Drainage Ditch. SECTION 3. That the necessity to execute Change Order No. 2 to the contract with Maverick Construction Company for Hearn Road drainage ditch improvements and to appropriate the sums necessary to construct the improvements at the earliest practicable date creates a public emer- gency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally -on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally -on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the c20 day of September, 1978. CHANGE ADD DEDUCT 1. Enlarge the proposed concrete retard structure that sits over the existing 48" waterline Sta. 10 +10± and add a small grate inlet to be tied to the retard structure. Also extend the re- taining wall from 1.5' to 7.51. All additional work, material 'and labor for lump sum price of $4,300.00 - see attached -sketch for further details. .$4,300.00 2. .;Delete 200 L.F. of 10" high channel wall with an 18" base and add 200 L.P. of 15" R.C.P. between the two concrete retard structures at no extra charge. Total: $4,300.00 Why was this change necessary? (If left off the plans and specifications, explain why.) The change was necessary in order to protect the existing 48" waterline which has been undermined by the continuous water flow from the C.P. & L. power plant. How can similar changes be avoided in the future? More thorough investigation during the planning and design stages.
