BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to submit a grant application to the Governor's Office of Traffic Safety 1 for $100,265.02 to continue from October 1, 1978 to September 30, 1979 the selective traffic enforcement program, all as more fully set forth in the application, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. That the City Manager be authorized to-execute all documents necessary to implement the grant and continue the program aforesaid. SECTION 3. The necessity to authorize submission of the said grant application and the execution of such documents as may be necessary in order to continue the selective traffic enforcement program creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the__,gD day of September, 1978. There are also two colleges, a Naval Air Station and an Army Depot. Tourism is an all -year industry, with beach traffic in the summer and "Winter Texans" and retirees during the other seasons. The City covers 1,526 square miles, and has a population of more than 210,000. Traffic accident base data for 1975, 1976, and 1977 is as follows: 1977 1976 1975 Accidents 7,599 7,397 7,245 Deaths 47 38 33 Injuries 2,380 2,142 1,918 In order to reduce the serious traffic accident problem, the City of Corpus Christi operates a traffic enforcement program concentrating primarily on alcohol - related and DWI offenses. This program, called the "Blue Light Squad," and the Selective Traffic Enforcement Program funded in part by this office during fiscal year 1978, reflect'a sincere desire on the part of the City to save lives and reduce injury and property damage accidents. This contract is intended to provide flexibility for the City of Corpus Christi to analyze their safety problems and take appropriate corrective action. Also, this agreement identifies the responsibilities of the City of Corpus Christi and the Office of Traffic Safety, State Department of Highways and Public Transportation. II. This project has been authorized by the Highway Safety Plan for Fiscal Year 1979, in conformance with Program Module 79 -01 and Problem Solution Plan #79- 01 -01. III. The City of Corpus Christi shall: A. Agree to the following project objectives: 1. To utilize on an overtime basis qualified patrolmen, who will be selected on the basis of traffic law experience and self - motiviation from existing personnel with a basic law enforcement certificate (issued by the Texas Commission on Law Enforcement Officers Standards and Education). STEP patrolmen shall work those locations described in the Operational Plan to enforce existing laws, primarily unsafe speed, alcohol - related violations, failure to yield and other hazardous moving violations. 0I., VURM A9 I NEW 9175 PAGE 1 OF _ Contract o Attachment 1 'STEP,- Corpus Christi Page 2 2. Provide officers on an overtime basis, patrol vehicles, and other equipment required to conduct the Selective Traffic Enforcement Program as identified in the latest Operational Plan. 3. Operate the Selective Enforcement units according to the Operational Plan, Attachment 4 to this contract. 4. The City of Corpus Christi shall reserve the right to amend the STEP Operational Plan as the need arises in order to improve the program. Such amendment will be made only with written concurrence from the Office of Traffic Safety District Manager. B. Provide the Office of Traffic Safety District Office assistance in the evaluation of the project. Such evaluation, described in #V, below, will be undertaken on a quarterly basis, and at the conclusion of the contract. C. Submit the following reports: 1. Quarterly Project Claim and Periodic Report in accordance with General Provisions X and Attachment 5. 2. Monthly Technical Reports in accordance with Attachment 6. D. Agree to the following audit requirements: 1. This project is subject to audit in compliance with Federal Management Circular 74 -4 and applicable State requirements. 2. Documentation to support costs claimed for reimbursement shall include, but not be limited to, the following: a. Payroll Register b. Time Records c. FICA Records d. Insurance (Workers Compensation) e. Mileage Logs f. Retirement Contribution Records IV. The Office of Traffic Safety, State Department of Highways and Public Transportation, shall: A. Provide reasonable technical assistance in accomplishing the project tasks. C. Monitor the project at a minimum of once per quarter, in accordance with the Office of Traffic Safety Project Monitoring System. Areas to be monitored include (but are not limited to) the following: . 1. Arrest Record Findings. 2. Time Distribution Records. 3. Monthly and Quarterly Reports. 4. Mileage Logs. V. Evaluation Evaluation of the project will be by statistical analysis and admin- istrative assessment. Statistical data for STEP site accident experience will be compared to data for the comparable period of the preceeding year to determine if the goal of 5% reducation in total accidents in STEP sites has been achieved. Additionally, an administrative assessment of the efficiency and effectiveness of the project will be undertaken. Areas to be considered in this assessment may include (but not be limited to) the following: A. Systematic assignment of available police manpower and equipment resources to identified problems and areas. B. That manpower so assigned are consistently working against those violations that contribute to the accidents at the times of day and day of week at high accident locations. C. Comparison of enforcement actions with violations which are accident causative at the times and locations as described in the Operational Plan. D. Provide information necessary to determine the level of enforce- ment by contacts or arrests per man hour or per unit hour by type (arrest /citation /warning) and by violations. Management tools such as the enforcement index (number of convictions with penalty OR hazardous violations OR contacts, divided by the number of fatal and injury accidents) may be used to compare STEP activity with the community -wide enforcement index. Unless prior approval in writing is obtained from the Office of Traffic Safety, State Department of Highways and Public Transportation, no costs may be incurred after the end of the contract period specified. 2. Overtime records must document the distribution of both regular time and overtime worked for traffic safety and all other activities. 3. All expenditures shall be in strict compliance with monies allocated in the approved contract. 4. All costs reimbursed are subject to verification by the State Department of Highways and Public Transportation auditors. 5. Approval of this contract is for the stated period only. This approval does not commit or promise to commit funding for any subsequent period. 6. All costs claimed for reimbursement shall be categorized in accordance with the estimated budget. 7. Equipment purchased with funds from the Texas Office of Traffic Safety, for the purpose of this contract implementation and performance is subject to the conditions in National Highway Traffic Safety Administration Policy Memorandum Number R6- B -501A, which provides: If equipment is no longer available to the project through loss, theft, accident, or circumstance other than normal wear, it shall be the responsibility of the grant recipient to provide for replacement of such equipment. If the equipment retained by the recipient subsequent to the project period for continued traffic safety use becomes unusable for any reason, the responsibility for replacement shall be the grant recipient's and shall be ineligible for Federal participation under this program. Contract # SELECTIVE TRAFFIC ENFORCEMENT PROGRAM CITY OF CORPUS CHRISTI OPERATIONAL PLAN FISCAL YEAR 1979 The City of Corpus Christi assigns police officers within census tracts. Each census tract contains several patrol districts made up of a few blocks each. The Selective Traffic Enforcement Program will operate in the eight census tracts with the highest accident rates. These are: #24 - Residential and Shopping Center Area. # 3 - "T- Head," Bayshore, and Downtown Business Area. #12 - Central Business District Fringe and Apartment Area #19 - Expressway, Shopping Centers, Light Business and Bar Area. #27 - Shoreline, Light Business, Residential and University Area. #34 - Residential, Light Business and Expressway Area. #18 - Expressway, Shopping Center, Light Business and Bar Area #26 - Business, Shopping Center and Residential Area. Based on analyses from the Accident Location Coding Program and the City information files, the following plan of action will be implemented: 1. The Corpus Christi Police Department will utilize six officers and one supervisor, plus one clerical person and necessary Municipal Court clerk time per STEP operational day. 2. The officers and supervisor will operate primarily in single -man units. 3. The enforcement effort will concentrate on unsafe speed, failure to yield right -of -way, alcohol - related violations, following too close, and other hazardous moving traffic violations on days and at times indicated by the traffic statistical reports. 4. Initially the days and times of patrol will be Tuesday through Saturday, 3 PM through 7 PM. 5. The City of Corpus Christi reserves the right to amend the operational plan if the program can be improved, subject to written approval of the Office of Traffic Safety District Manager. 6. The City will continue to operate the "Blue Light Squad ", concen- trating on Driving While Intoxicated offenses. Prucdures PR- 1.3.1,5,6, • 7 11/75 INSTRUCTIONS FOR PREPARATION OF A TJ;XAS TRAFFIC SAFETY PROGRAM PROJECT CLAIM AND PERIODIC R3PORT SCOPE; This document provides instructions for the completion of OTS forms PR- 1,3,4,5,6, and 7; referred to collectively as the 'TEXAS TRAFFIC SAFETY PROGRAM CLAIM AHD PERIODIC RETORT* (Enclosures 1 thru 6). GENERAL; 1. Project claims and periodic reports are required under the terms of most Texas Traffic Safety Program contracts. Three types of claim/report forms may be specified by contract; these instructions shall be used if OTS form PR -1 is specified. 2. The OTS contract may require that project claims and periodic reports be submitted monthly, or quarterly, or one time (only). 3. The attachment forms (PR- 3,4,5,6, and 7) shall be assured to be required unless the contract (or other written directions frcm OTS) states otherwise. 4. It is recommended that a copy of the project contract and all changes thereto be reviewed before preparing a pro- ject claim and periodic report. PREPARATION OF OTS FORM PR -1 (Enclosure 1), I. FINAL REPORT - Check the appropriate block indicating whether or not this is the final report to be submitted under this contract. 2. PROJECT TITLE - Eater the project title as shown on the contract. OTS Form G-4 New 12/75 Page 1 of 17 3. PROJECT NUHDLR - Enter the project number, as shown on the contract, in the blocks provided. 4. MONTHLY /QUARTLRLY REPORT - Check the appropriate block. If the contract requires monthly reports, the claim and report shall cover exactly one calendar month (or less, if at the beginning or end of the project); insert the applicable calendar month and year. If the contract re- quires quarterly reports, the claim and report shall cover exactly one quarter (or portion thereof) of a fiscal year (Oct. 1 - Dec. 31, Jan. 1 - Mar. 31, Apr. 1 - June 30, or July 1 - Sept. 30); check the appropriate quarter and enter the calendar year. S. EXPENDITURES FOR THE REPORTING PERI00 A. GENERAL; 1) Routine - Unless otherwise approved in writing by OTS, expenditures shall be recorded on a cash basis; i.e., a cost shall be claimed in the period during which it is actually paid. However, since all costs eligible for reimbursement under the con- tract must be claimed during the period of the con- tract, any allowable costs incurred during the con- tract period, but paid after the contract period, shall be claimed during the final reporting period (monthly or quarterly) of the contract. Example, wages and /or employee benefits for the last week (or month) of the project are frequently paid after the end of the project; they should, however, be Page 2 of 17 o_ :3 R T C � �0 I'L 0 l", i { +. claimed as costs on the last (monthly or quarterly) report of the project. 2) Errors - In the event of an error in the amount claimed (either an overelaim or an underclaim), an adjustment may be made on a subsequent report by entering corrections (which my be positive or nega- tive in value). If an error is found subsequent to the final report, a supplementary claim may be submitted (use fors PR -1, with the words •SUPPLOMNTARY REPORT,' entered above the title). B. PERSONAL SERVICES, CONTRACT SERVICES, COMMODITIES. OTHER DIRECT COSTS AND INDIRECT COSTS - Enter the total amount* expended for the reporting period in the spaces provided, using the following category definitions: 1) Personal Services - Salaries and benefits of all , salaried personnel (for time actually spent working on the project), travel costs (fares, mileage, etc.), and other travel expenses (per disco or room rent, meals,'etc.). 2) Contract Services - Costs incurred under project subcontracts— (including consultant services) . 33 Commodities - The costs of expendable materials and supplies used on the project (prorated costs may be used if approved by OTS). *The project contract shows cost by these same categoriesr if match- ing costs are shown in the contract, include them in these spaces. If matching costs are not shown in the contract, do not include these spaces. •'Most subcontracts must be approved in advance by OTS (see contract requirements. Page 3 of 17 6) Other Direct Costs - The coat of purchase of necessary accountable assets, computer services, rentals, other services, etc. S) Indirect Costs - The percentage add -on cost authorized by contract (may include profit) . NOTEt Indirect costs may be charged only when permitted by contract. The requirements for sub- stantiation of indirect costs at audit "a often more severe than for direct costs. OTS forms PR- 3,4,5, and 6 shall be attached (as appli- cable) unless the requirement for these attachments has been waived in writing by OTS. C. TOTAL COST AND TOTAL COST CLAIMED FOR REIMBURSEMENT - 1) Total Cost - This is the sum of the costs, listed above (for the reporting period). 2) Total Cost Claimed for Reimbursement - This amount is computed on the basis specified in the contract; if the contract specifies loot cost reimbursement, this amount will equal the •total cost- (provided the total amount claimed on all reports may nevor exceed the 'Maximum Amount Eligible for Reimburse- ment') as shown in the contract. 6. CUMULATIVE EXPENDITURES AND CLAIMS - Enter the aum of expenditures shown on this report plus those on all prior reports as cumulative actual expenditures. Cumulative actual claimed is similarly computed from claimed amounts. Planned expenditures are only reported on quarterly reports or on the last monthly report for a quarter (December, Page 1 of 17 March, June or September) 1 enter the amount shown for the applicable period on page 1 of the contract. The planned claimed amount shall be computed from the planned expen- diture using the reimbursement formula set forth in the contract. 7. ACCOUNTABLE ASSETS LIST - An accountable assets list is required if, and only if, accountable assets have been (physically) acquired during the reporting period. If asseti have been acquired, check the first block and attach a copy of OTS form PR -7. If no assets were ac- quired during the reporting period, check the second block and omit the PR -7 attachment. S. SCHEDULE STATUS - List all milestones which are Scheduled in the contract for completion on or before the end of the reporting period and which have not been reported as com- pleted in previous reports. Enter the milestone number (project start is milestone 01, the nest milestone shown in the contract is 02, etei project complete is milestone 99), the milestone name (as shown in the contract), the planned completion date (as shown in the contract), and the actual completion date, if any. NOTES always show the latest contract information (including all Contract Change Notices). 9. NARRATIVE REPORT - The narrative report is divided into thm sections, Accomplishments, Problems Encountered, and Assistant* Required. These sections may vary is con- tent and detail as appropriate. Sections A a 8 must be consistent with the report of milestones met and missed (section t, above) and should cite reasons it the proj, is behind schedule or over budget. Section C provides the opportunity to identify problcme, needs, actions re- quired by OT•S, and recommendations to OTS. Any (or all) of the sections may be continued on separate sheets (in- cluded as attachments). The narrative section is an im- portent part of this report, and the project manager la encouraged to make effective use of this opportunity to communicate needs, problems, achievements, and other pertinent information. Please keep this narrative cection concise and interesting. Concentrate on major points rather than detailal include material of interest to other project managers. 10.. PROJECT ORGANISATION CHART - An organization chart is re- quired with the first project report. The form or format is optional, but all key personnel, including the protect manager, fiscal manager (or equal), evaluator (if any), etc., must be shown by name and function. On subsequent reports, the organization chart must be revised and re- submitted if, and only if, one or more of the key personnel change. Check the applicable block and attach a revised chart, if required. 11. SIGNATURB A. CLAIMANT - Enter the name of the organization sub- mitting the claim (this must be the organization shorn on the contract). S. GENERAL - These attachments are required if, and only if, corresponding costs are reported for the period; PR -3 is required if PERSONAL SERVICES are reported; PR -4 if SUN- CONTRACT SERVICES are required; PR -S if COMWDIT2ES are reported; and PR -6 if OTHER DIRECT COSTS are reported. D. EXTENTION OR AMOUNT PAID - The total amount (in dollars and cents) paid for the line entry. NOTES Equal to quantity multipled by rate (where applicable). E. 'DOCUMENT - Identify the instrument (document) used to pay the amount shownt show the type of document (check, warrant, etc.), and identify number (check no., warrant no., etc.). NOTES The document identified must be retained for audit in accordance with the General Provisions of the contract. F. TOTAL - Enter the total amount (in dollars and cents) in the space provided. NOTEt The totals must agree exactly with the amounts entered on the front of the PR -1 form. PREPARATION OF OTS FORM PR -7 (Accountable Assets Report)t 1. GENERAL - The Accountable Assets Report must be submitted whenever accountable assets are furnished by OTS or pus - chased. Once a PR -7 has been submitted on a contract, it must be resubmitted if, and only if, one or more assets Page a of 17 are acquired during any reporting period. Subsequent re- visions Of the PR -7 must include all assets previously shown (even if they have been disposed of); it is suggested that the organization submitting claims retain the ori- ginal PR -7 for subsequent updating and submit photocopies to OTS. 2. READING - Same as the heading for PR- 3,4,5, and 6. 3. OTS- UNIQUE TRANSACTION - Enter the 10 -digit OTS code for the asset (for example: MN00006102), if known; if unknown, leave blank. 4. USER IDENT - Enter the inventory number used by the claimant organization. NOTE: If none is used, a number system must be created, a number assigned, and the number affixed to the asset (embossed tape is a useful method in some instances). 5. DESCRIPTION /SERIAL NO. - Enter a meaningful description of the asset and its serial number (if applicable). Examples Of *useful' descriptions are: - A. Typewriter, IBM Selectric II, S/Nxxxxxx... B. Desk, Secretarial, 30' x 60', left hand, walnut C. Pile Cabinet, 4 -dr., legal, black metal In general, manufacturers names are not useful, except in soma instances where they uniquely define a type, style, or quality: for example, •IBM Selectric II' or 'HP -45' are useful identifiers but 'Casemark' or `Shaw - walker' are 'generally not. 6. PURCHASE COST - Enter the exact amount paid for the item, Page 9 of 17 $ra if purchased. If furnished (from a previous contract or from another source by OTS),enter 'OTS.' 7. ACQUISITION DATE - Enter the date the asset vas received or transferred to the project. 0. DISPOSITION - If an asset is destroyed, stolen, or trans- ferred to another project respectively, enter 'DESTROYED, - 'STOLEN,• or the new project number and date of transfer in this column (if the new project number is not kno", it can be obtained from the responsible OTS manager) . NOTE: If an item is destroyed or stolen, the full details must be documented; contact the responsible OTS manager for details. If an asset is transferred to another or- ganization, an Accountable Assets Log (OTS form AA -2) must be furnished to you to clear your record. (see the respon- sible OTS manager for details). SUBMITTAL - The completed and signed PR -1, with attachments, must be forwarded, in duplicate, to the responsible OTS manager. It will be reviewed and processed in accordance with OTS policy, and reimbursement may be expected within two to six weeks if no major problems are encountered in the review. The exact period required will depend upon immediate processing backlog In the OTS office and the State Comptroller's office, mail delays, and other in- cidental factors.
