HomeMy WebLinkAbout14514 ORD - 09/20/1978jkh:9- 20- 78;ist AN ORDINANCE AI CLOSING AND ABANDONING THE 10 -FOOT UTILITY EASEMENT LOCATED ALONG THE WESTERLY BOUNDARY OF LOT 25 -A, BLOCK D,• LEVEK TRACT, RECORDED IN VOLUME 43, PAGES 126 -127, MAP RECORDS OF NUECES COUNTY, TEXAS; PROVIDING FOR SEVERA- BILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot utility easement along the westerly boundary of Lot 25 -A, Block D, Levek Tract, recorded in Volume 43, at pages 126 -127, Map Records of Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 10 -foot utility easement located along the westerly boundary of Lot 25 -A, Block D, Levek Tract, recorded in Volume 43, pages 126 -127, Map Records of Nueces County, Texas, and more particularly described as follows be and the same is hereby closed and abandoned for public use and every municipal purpose, and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi: BEGINNING at a 5/8 inch iron rod found on the South right -of- way line of Corona Drive for the common front corner of said Lot 25A and Lot 26, Block D, Levek Tract, a map of which is recorded in Volume 41, Pages 174, 175 of said map records and the East corner of this easement; THENCE South 29 °01150" West, along the common boundary line of said Lots 25A and Lot 26, Block D, 259.52 feet to a 5/8 inch iron rod found for an inside corner of Lot 25A and the West corner of Lot 26 for an inside corner of this easement; THENCE South 60 058110" East, along the common boundary line of said Lots 25A, 26, 14.20 feet for a corner of this easement; THENCE South 29 °01'50" West 10.00 feet for the South corner of this easement; THENCE North 60 °58'10" West 24.20 feet for the West corner of this easement; THENCE North 29 °01'50" East 264.93 feet to a point on said South right -of -way line of Corona Drive for the North corner of this ease- ment; 14514 4 THENCE South 85 °58'20° East, along said right -of -way, 2.26 feet to the point of curvature of a circular curve to the right which has a central angle of 00 °58'28 ", a radius of 523.84 feet, a tangent dis- tance of 4.37 feet and an arc length of 8.74 feet; THENCE with said curve to the right, along the South right -of -way line of Corona Drive, 8.74 feet to the POINT OF BEGINNING, containing 2,824 square feet of land. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the abandoning of the aforesaid easement creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the .20 day of September, 1978.
