AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE REVOCABLE
EASEMENT TO SOUTH TEXAS PIPELINE COMPANY FOR PLACING
TWO PIPELINES IN A PORTION OF McKINZIE ROAD, ALL AS
MORE FULLY SET FORTH IN THE REVOCABLE EASEMENT, A
SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO, MARKED
EXHIBIT "A ", AND MADE A PART HEREOF; AND DECLARING AN
EMERGENCY,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute and deliver, for and on behalf of the City of Corpus Christi,
an instrument of revocable easement to South Texas Pipeline Company for
placing two pipelines in a portion of McKinzie Road from 5570 feet south
of Kingsbury Road, thence northerly to the Nueces River, for a fee of
$7,430.40, all as more fully set forth in the said revocable easement, a
substantial copy of which is attached hereto and made a part hereof, marked
Exhibit "A ".
SECTION 2. The necessity for commencement of construction of
pipelines at the locations described herein creates a public emergency and
an imperative public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the date
of its introduction but that such ordinance or resolution shall be read
at three several meetings of the City Council, and the Mayor having declared
such emergency and necessity to exist, and having requested the suspension
of the Charter rule and that this ordinance be passed finally on the date
of its introduction and take effect and be in full force and effect from
and aJ.itspassage, IT IS ACCORDINGLY SO ORDAINED this the aday

REVOCABLE EASEMENT
THE STATE OF TEXAS
COUNTY OF NUECES X
THAT, the City of Corpus Christi, Texas acting by and through its duly
authorized City Manager, R. Marvin Townsend, for and in consideration of the sum
of Seven Thousand Four Hundred Thirty and 40/100 Dollars ($7,430.40) to it in
hand paid by South Texas Pipeline Company, a Deleware Corporation, hereinafter
referred to as GRANTEE, said fee to be based on the charges specified by City
Ordinance No. 10477, for installing a 6" and an 8" pipeline within McKinzie
Road and McKinzie Lane, various street crossings and across City owned property,
'the receipt of which is hereby acknowledged and confessed, has GRANTED, SOLD and
CONVEYED, and by these presents does GRANT, SELL and CONVEY, upon the conditions
hereinafter stated, unto the said South Texas Pipeline Company, the right to lay,
construct, operate, maintain, repair and remove one (1) 6" and one (1) 8"
petroleum products pipeline crossing of the right -of -way of McKinzie Road approx-
,imately at right angle at a point approximately 5570 feet south of the centerline
of Kingsbury Road; then in McKinzie Road from a point approximately 250 feet
south of Kingsbury Road 2821 feet to a point approximately 358 feet south of
,Mobile Drive; then crossing 60 feet wide Mobile Drive at a point 55 feet east of
the intersection of the centerlines of Mobile Drive and McKinzie Road; then in
,McKinzie Road from the south right -of -way line of Leopard Street 568 feet to a
point approximately 30 feet north of the north right -of -way line of Harrington
Drive; then in City property (Lot 1, Block 7, Highway Village Section 1 Annex)
:182 feet to the north line of said Lot 1; then in McKinzie Road from a point
approximately 570 feet south of Up River Road 616 feet to the north right -of -way
line of Up River Road; then crossing IH -37 at a point approximately 110 feet east
of its intersection with the centerline of McKinzie Road a distance of 304 feet;
then in McKinzie Road from a point approximately 300 feet north of the intersection
of the centerlines of McKinzie Road and IH -37, 723 feet to a point 7 feet south
of the north right -of -way line of McKinzie Lane: then in McKinzie Lane
from McKinzie Road 691 feet to a point where the pipelines leave
McKinzie Lane and enters the City owned Sid Allison Sewer Plant Site

property (Nueces View Tract, Volume 28, Page 64 N.C.T.M.R.); then in a northerly
direction on the said City owned Sid Allison Sewer Plant Site, 3830 feet to a
crossing of the Nueces River; all as shown on the location map marked "Exhibit A"
and detailed plans marked "Exhibit B" thru "Exhibit 0 ".
TO HAVE AND TO HOLD the same unto the said South Texas Pipeline Company,
their successors and assigns, together with the right and privilege at any and
all times to enter upon the above strip of land for the purpose of constructing
and maintaining the said pipelines for transportation of oil, gas or petroleum
products at said locations, and it is further understood that the foregoing
easement and right is granted upon the following conditions and terms:
1. All work proposed will equal or exceed Department of Transportation
,Pipe Line Safety Standards for the transportation of gas and liquids by pipe line.
2. A complete set of construction plans showing the location and depth
of all City -owned utilities and /or storm sewer will be furnished to the Director
-of Engineering & Physical Development of the City, prior to any work being per-
formed in the public rights -of -way, per this instrument. Such plans will clearly
indicate methods of protecting and /or clearance requirements for City facilities.
The Director of Engineering & Physical Development will determine the number of
sets of plans involved.
3. Unless otherwise approved by the Director of Engineering & Physical
Development, all road crossings are to be bored. Each pipe line shall be encased
:in a steel casing for the full width of the street right -of -way at each street
crossing. The casing shall have a design strength at least 10% greater than the
pipe line it encases.
4. Maximum operating pressure for lines will be 2640 P.S.I. for 8" pipe
and 1775 P.S.I. for 6" pipe.
5. It is understood and agreed that the right and easement herein
granted may be revoked at any time by the City of Corpus Christi, and Grantee
may be required to remove the aforesaid pipeline upon thirty (30) days notice
in writing.
6. Grantee will save and keep harmless the City of Corpus Christi,
from any and all claims for liability by reason of the construction of said
pipeline, or the operation, maintenance or existence thereof.

7. Grantee will repair 'or cause to be repaired any damage to any street,
sewer, storm sewer, drainage facility, underground lines, wires, or pipes owned
by the City of Corpus Christi or holders of any franchise from the City, by
reason of the construction of said pipelines and the operation and maintenance
hereof. Grantee will apply to the Director of Engineering and Physical Develop-
ment for a permit before disturbing any part of any street or sidewalk area and
perform the work in accordance with the permit and all City ordinances applicable.
8. All rights granted hereby shall be subordinate to all uses as the
City may make of such street right -of -way for public purposes.
a. Grantee shall adjust or relocate the above described pipelines, if
necessary, for the construction of any public utilities or change in street grade
or patterns on the streets or for any other reason of the City stated in writing
to Grantee, at the points above described.
b. Grantee will erect markers at the points where such pipeline enters
or leaves a street right -of -way. Such markers shall be of iron, bearing pipeline
owner's name, and placed at the edge of the public right -of -way.
9. This conveyance and agreement, and all the terms and provisions
hereof, shall bind and inure to the benefit of Grantor and Grantee and the
respective heirs, lessees, licensees, successors and assigns of Grantor and Grantee.
Grantee, its successors and assigns, is hereby expressly given and granted the
right to assign the rights and easements herein granted and conveyed or any part
thereof or interest therein to any person, firm, corporation, partnership or other
entity, and such rights and easements are and shall be divisible among two or
more owners so that each assignee or owner shall have and enjoy said rights and
easements either separately or together; provided, however, that any assignment
of the rights or easements granted hereunder shall be subject to Grantee obtaining
prior approval and concurrence of Grantor. In the event Grantee abandons any of
the rights or easements granted hereunder, Grantee shall notify Grantor in writing
of such abandonment.
10. Grantee is expressly prohibited from the sale and distribution of
natural gas to consumers, whether industrial, commercial or residential, within the
corporate limits of the City of Corpus Christi. It is expressly provided that,
as used in this paragraph, the sale of "natural gas" shall not include the inter-
company sale or transfer of either fuel gas, or fuel in any form, used and consumed
in the fractionation, heating, distilling, or manufacturing process of Grantee,
its subsidiaries and affiliates.

It is mutual understood and agreed that this agreement as written
covers all covenants, agreements and stipulations between the parties and
that no representations or statements, written or oral, have been made modi-
fying, adding to or changing the terms hereof, and that the party securing
this conveyance on behalf of Grantee is without authority to make any repre-
sentation, stipulation, covenant or agreement not herein expressed.
