HomeMy WebLinkAbout14543 ORD - 10/04/1978jkh- TO- 3- 78;1st E AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS FOR THE ACQUISITION OF A PARCEL OF LAND FROM PAISANO, LTD., IN CONNECTION WITH THE LOS ENCINOS PARK PROJECT; APPROPRIATING $61,059, OF WHICH SUM $36,059 IS OUT OF THE NO. 291 PARK BOND FUND, PROJECT NO. 291 -72 -3, OF WHICH $30,750 IS FOR LAND ACQUISITION, $309 IS FOR INCIDENTAL COSTS RELATED TO CLOSING, AND $5,000 IS FOR THE INSTALLATION OF AN 8 -INCH WATER LINE PERPENDICULAR TO GREENWOOD DRIVE AND EXTENDING THE ENTIRE DISTANCE'OF THE PROPOSED 6.753 -ACRE PARK, AND THE SUM OF $25,000 IS OUT OF THE NO. 220 STREET BOND FUND, PROJECT NO. 220- 72 -56, AS THE CITY'S COST OF CURB, GUTTER AND SIDEWALK IN CONNECTION WITH CONSTRUCTION OF A ROAD ALONG THE PARK BOUNDARY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute the necessary documents for the acquisition of a parcel of land from Paisano, Ltd., in connection with the Los Encinos Park Project, said parcels or tracts being more particularly described as follows: PARCEL NO. 1 TRACT I Being a square shaped tract of land out of Lot 8, Section 7, BOHEMIAN COLONY LANDS as shown by map of record in Volume A, Page 48, Map Records, Nueces County, Texas, and more parti- cularly described by metes and bounds as follows: Beginning at a point on the original centerline of 80.0 foot wide Greenwood Drive, said point being the Southwest corner of abovementioned Lot 8; Thence S. 600 40' E., at right angles to said original center- line of said Greenwood Drive, a distance of 40.0 feet to a point on the Easterly right -of -way line of said Greenwood Drive for the beginning point of the tract of land herein described; =0- L , UJU'L 0 5 1986 14543 Thence N. 290 20' E.; along the Easterly right -of -way line-'O'f said Greenwood Drive, a distance of 361.50 feet to a point for a corner of this tract; Thence S. 60o 40' E., a distance of 361.50 feet to a point for a corner of this tract; Thence S. 290 20' W,, a distance of 361.50 feet to a point on the Southerly boundary line of abovementioned Lot 8; Thence N. 60° 40' W., along the Southerly boundary line of said Lot 8, a distance of 361.50 feet to the place of begin- ning and containing 3.00 acres, more or less. TRACT II - Dedication Being an irregular shaped tract of land out of Lot 8, Section 7, Bohemian Colony Lands as shown by map of record in Volume A, Page 48, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at a point on the original centerline of 80.0 foot wide Greenwood Drive, said point being the Southwest corner of above - mentioned Lot 8; Thence S. 600 40' E., at right angles to said original centerline of said Greenwood Drive, a distance of 40.0 feet to a point on the Easterly right -of -way line of said Greenwood Drive; Thence N. 290 20' E., along the Easterly right -of -way line of said Greenwood Drive, a distance of 361.50 feet to a point being the be- ginning point of the tract of land herein described; Thence continue N. 290 20' E., along the Easterly right -of -way line of said Greenwood Drive, a distance of 180.88 feet to a point for the most Northerly corner of this tract; Thence S. 600 40' E., a distance of 542.38 feet to a point; -2- .�. '�. °.S i Thence S. 290 20' W., a distance of 542.38 feet to a point on the Southerly boundary line of abovementioned Lot 8; Thence N. 600 40' W., along the Southerly boundary line of said Lot 8, a distance of 180.88 feet to a point being the most Southerly corner of a 3 acre tract of land (Tract 1) to be purchased by the City of Corpus Christi, Texas, for park purposes; Thence N. 290 20' E., along the Easterly boundary line of said 3 acre tract, a distance of 361.50 feet to a point being the most Easterly corner of said 3 acre tract; Thence N. 600 40' W., along the Northerly boundary line of said 3 acre tract, a distance of 361.50 feet to the place of beginning and con- taining 3.753 acres, more or less. SECTION 2. That there is hereby appropriated the sum of $61,059, of which sum $36,059 is out of the No. 291 Park Bond Fund, Project No. 291 -72 -3, of which $30,750 is for land acquisition, $309 is for incidental costs related to closing, and $5,000 is for the installation of an eight -inch water line perpendicular to Greenwood Drive and extending the entire dis- tance of the proposed 6.753 -acre park, and the sum of $25,000 is out of the No. 220 Street Bond Fund, Project No. 220- 72 -56, as the City's cost of curb, gutter and sidewalk (one -half of total cost) for the construc- tion of a road along the park boundary. SECTION 3. The imperative public necessity to acquire the aforesaid parcels or tracts of land at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect -3- and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of October, 1978.
