WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendments to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on October 18, 1978, at Regular Council Meeting of the City Council in the City Council Chambers of the City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance;and, that permanent zoning of "I -2" Light Industrial District should be granted to the tract of land described herein. (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning. (3) That the permanent zoning of "I -2" Light Industrial District be granted thereto. WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth MIC OFR ILME- 14568 1� amendment would best serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the changes hereinafter set out. , SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31 -5, by adding thereto a new subsection to be numbered Section 31 -5.20, said new sub- section to hereafter read as follows: "Section 31 -5.20 The following described tract of land shall be zoned and classified 'I -2' Light Industrial District: Being a 26.3 acre tract of land, more or less, out of Lot 1, Section 14, Bohemian Colony Lands, a map of which is recorded in Volume A, page 48, Map Records of Nueces County, Texas: Beginning at the point of intersection of the West right - of -way line of Chapman Ranch Road (State Highway No. 286) and the South line of said Lott for the Southeast corner of this tract from which corner the Southeast corner of said Lot 1 bears South 61° 32' 00" East 50.00 "feet; Thence North 61° 32' 00" West, along the South line of said Lot 1, 923.73 feet, more or less, for the Southwest corner of this tract; Thence North 29° 00, 00" East 1260.00 feet, more or less, to a point on the South right -of -way line of Saratoga Boulevard (State Highway No. 357) for the Northwest corner of this tract; Thence South 61° 32' 00" East, along said South right -of- way line of Saratoga Boulevard, parallel with the centerline thereof and 60.00 feet distant therefrom, measured at right angles thdzeto, 793.73 feet, more or less, for an angle point in said right -of -way and the Northwest corner of this tract;" Thence South 00° 02, 50" West, with the continuation right -of -way line of Saratoga Boulevard, 227.90 feet, more or less, to the point of intersection with said West right -of -way line of Chapman Ranch Road for a corner of this tract; Thence South 29° 00' 00" West, along the West right -of -wag line of Chapman Ranch Road, 220.00 feet, more or less, for a corner of this tracts. Thence continuing with said right -of -way, South 23" 000 ,00" West 201.00 feet, more or less, for a corner of this tract; Thence South 29° 00' 00" West, with the West right. -of -wag line of Chapman Ranch Road, parallel to the centerline thereof and 50.00'feet distant therefrom, measured at right angles thereto, 640.00 feet, more or less, to the POINT OF BEGINNING. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 5. The necessity of making the aforesaid change immedi- ately for the purpose of maintaining at all times a comprehensive zoning ordinance.for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally -on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the__a_day of October, 1978.
