HomeMy WebLinkAbout14571 ORD - 10/25/19784 jkh:10- 25- 78;lst AN ORDINANCE CLOSING THE PORTIONS OF JOHANNA STREET LOCATED GENERALLY BETWEEN KOSTORYZ ROAD AND RICHTER STREET AND ADJACENT TO THE PROPOSED VENTURA PLAZA UNIT 5 SUBDIVISION, ALL AS MORE FULLY DESCRIBED HEREINAFTER; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing con- cerning the closing of a portion of Johanna Street, situated in the City of Corpus Christi, Nueces County, Texas, was given by publication and mail to the last known address of the owners of property abutting said street and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting of the City Council of the City of Corpus Christi on Wednesday, October 11, 1978, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing thatit would best serve the public convenience and necessity to close the portion of Johanna Street located generally between Kostoryz Road and Richter' Street and adjacent to the proposed Ventura Plaza Unit 5 Subdivision, and that the same revert to the abutting property owners: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: f SECTION 1. That the following described portions of Johanna J. __ Street, situated in the City of Corpus Christi, Nueces County, Texas, be and the same are hereby closed for public use and abandoned to the abutting property owners: FIELDNOTES for the closure of a portion of Johana Street in Lexington Village, a map of which is recorded in Volume 12, Page 29, Map Records of Nueces County, Texas: BEGINNING at the West subdivision corner of said Lexington Village for the West corner of this tract; THENCE North 29° East along the Northwest subdivision line of said Lexington Village 25.00 feet to the West corner of Lot 24 of said Lexington Village and the North corner of this tract; THENCE South 61 030' East along the Southwest boundary line of said Lot 14, 147.30 feet to the point of curvature of a circular curve to the left whose point of radius bears North 28 °30' East 30.00 feet having a central angle of 89 °30', radius of 30.00 feet, tangent distance of 29.74 feet for an arc length of 46.86 feet; THENCE along said curve to the left, 46.86 feet to the point of tangency and the East corner of this tract; 1-4Sw1 THENCE South 29° West along the Southwest extension of the Northwest right -of -way line of Larcade Drive 54.74 feet to a point on the Southwest subdivision line of said Lexington Village and the South corner of this tract; THENCE North 61 °30' West along the Southwest subdivision line of said Lexington Village 177.04 feet to the POINT OF BEGINNING, con- taining 4615 square feet of land. FIELDNOTES for'the closure of a portion of Johanna Street adjacent to Lots C and D, Boulevard Acres, a map of which is recorded in Volume 23, Page 50, Map Records of Nueces County, Texas: BEGINNING at the South corner of said Lot C for the West cor- ner of this tract; THENCE North 29° East along the Southeast boundary line of said Lot C 25.00 feet to the West corner of said Lot D and the North cor- ner of this tract; THENCE South 61 °33' East along the Southwest boundary line of said Lot D 64.35 feet to the East corner of this tract; THENCE South 29° West 25.00 feet to the South corner of this tract; THENCE North 61 °33' West along the existing Southwest right - of -way line of Johanna Street 64.35 feet to the POINT OF BEGINNING, containing 1,609 square feet of land. FIELDNOTES for the closure of a portion of Johanna Street in Lexington Village, a map of which is recorded in Volume 12, Page 29, Map Records of Nueces County, Texas: BEGINNING at the South subdivision corner of said Lexington Village for the South corner of this tract; THENCE North 61 °30' West along the Southwest subdivision Sine of said Lexington Village 150.26 feet to the point of intersection with the Southwest extension of the Southeast right -of -way line of Larcade Drive and the West corner of this tract; THENCE North 29° East along the Southwest extension of the South- east right -of -way line of Larcade Drive 55.26 feet to the point of curvature of a circular curve to the left whose point of radius bears South 61° East 30.00 feet having a central angle of 90 °30', radius of 30.00 feet, tangent distance of 30.26 feet for an arc length of 47.39 feet and the North corner of this tract; THENCE along said curve to the left 47.39 feet to the point of tangency; THENCE South 61 °30' East along-the Southwest boundary line of Lot 1, of said Lexington Village 120.00 feet to the Southeast subdivision line of said Lexington Village for the South corner of said Lot 1 and the East corner of this tract; THENCE South 29° West along the Southeast subdivision line of said Lexington. Village 25.00 feet to the POINT OF BEGINNING, con- taining 3,954 square feet of land. -2- SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity J would be better served by the closing of the hereinabove described portions of Johanna Street creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the aS day of Octo er, 1978.
