AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDED
CONTRACT WITH THE COUNTY OF NUECES FOR SPONSORSHIP
OF THE NUECES COUNTY MENTAL HEALTH - MENTAL RETARDATION
PROGRAM, IN SUBSTANTIALLY THE FORM ATTACHED HERETO,
MARKED EXHIBIT "A ", AND MADE A PART HEREOF; AND
DECLARING AN EMERGENCY.
WHEREAS, by Ordinance No. 12494, passed and approved by the City
Council on February 26, 1975, authorization was given for execution of a joint
contract with the County of Nueces for sponsorship of the Nueces County
Mental Health - Mental Retardation Community Center for mental health and mental
retardation services under the laws of the State of Texas; and
WHEREAS, by Ordinance No. 12576, passed and approved on April 2,
1975, the aforesaid contract was amended by mutual agreement between the
parties thereto; and
WHEREAS, it has been determined by the parties to the aforesaid con-
tract that it would be advantageous to amend the said contract:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute an amended contract with the County of Nueces for sponsorship of the
Nueces County Mental Health - Mental Retardation Program, in substantially
the form attached hereto, marked Exhibit "A ", and made a part hereof.
SECTION 2. The necessity to authorize execution of the afore-
said contract at the earliest practicable date creates a public emergency
and an imperative public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the date
of its introduction but that such ordinance or resolution shall be read
at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, and having requested the
suspension of the Charter rule and that this ordinance be passed finally
on the date of its introduction and take effect and be in full force and

effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this

KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, the County of Nueces and the City of Corpus Christi entered
into a joint contract for the purpose of establishing and operating the Nueces
County Mental Health - Mental Retardation CmrL dty Center for mental health and
mental retardation services under the laws of the State of Texas; and
WtErMS,•it has been determined by the parties to the aforesaid
contract that it would be advantageous to amend the said contract:
NOW, THEREFORE, BE IT AGREED by the sponsoring agencies, County of
Nueces and City of Corpus Christi, that the contract heretofore entered into
betwen the parties be and the same is hereby amended by adding a new section
"F" to read as follows:
"F. ASSUMPTION OF DUTIES.
1. During the period ending July 31, 1979, the County will assume
all duties previously performed jointly by said County and City as set out in
Sections A, B, C and E of the joint contract, including the appointment of all
board members to the Commmity Center which shall become vacant during the
Period ending July 31, 1979. In addition, the County will appoint the Public
Responsibility Committee mandated by the MR Persons Act of 1977.
2.' It is specifically understood by the parties through this agreement
that the County will not provide all local government funding. For the current
fiscal year 1978 -1979 the City of Corpus Christi agrees to provide the MR-M
Cmrunity Center with $ 40,000.00 and the County of Nueces agrees
to provide the MH-MR Cammmity Center with $ 80,000.00 The County
and City agree to conduct a joint meeting on or before July of 1979 and prior
to the adoption of the City budget, to discuss continuation of this agreement,
including a determination of the amount the City and the County will consider
contributing to the NH-MR C mmmity Center in fiscal year 1980 budget."
Except as herein and hereby amended, the terns and conditions of the
contract heretofore entered into by the parties shall be and remain in full
force and effect including amendment of April 22, 1975.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
