HomeMy WebLinkAbout14578 ORD - 10/25/1978vp:10 /25/78clst u A AN ORDINANCE AUTHORIZING APPLICATION FOR DESIGNATED FEDERAL SURPLUS PROPERTY FROM THE GENERAL SERVICES ADMINISTRATION THROUGH THE HERITAGE CONSERVATION AND RECREATION SERVICE FOR 126.97 ACRES OF LAND DESCRIBED AS CORPUS CHRISTI TRACKING STATION, ROOD FIELD, GSA CONTROL NUMBER 8000 -19435 LOCATED IN THE COUNTY OF NUECES, STATE OF TEXAS; CERTIFYING THE ELIGIBILITY OF THE CITY OF CORPUS CHRISTI TO RECEIVE FEDERAL SURPLUS LAND; DESIGNATING THE CITY MANAGER AS RESPONSIBLE OFFICER FOR THE PROJECT AND AUTHORIZING HIM TO EXECUTE ALL DOCUMENTS NECESSARY TO OBTAIN THE SURPLUS LAND AND AUTHORIZING THE CITY MANAGER TO PAY THE ADMINISTRATIVE EXPENSES INCIDENT TO THE TRANSFER, AND DESIGNATING THE FINANCE DIRECTOR AS FISCAL OFFICER FOR THE PROJECT; AND DECLARING AN EMERGENCY. WHEREAS, the City Council desires to apply for the federal surplus property described as Corpus Christi Tracking Station, Rodd Field, GSA Control Number 8000 - 19435, 126.97 acres, for the purpose of developing an open space and recreation area; and WHEREAS, the City of Corpus Christi is a municipal corporation, a home rule city and a political subdivision of the State of Texas, and that application is being made under the provisions of Section 203 (K)(2) of the Federal Property and Administrative Services Act of 1949, (63 Statute 387) as amended, and rules and regulations promulgated pursuant thereto; and WHEREAS, the City of Corpus Christi has legal authority, is willing and is in a position to assume immediate care and maintenance of Corpus Christi Tracking Station, Rodd Field; and WHEREAS, the City Council desires to designate the Director of Finance of the City of Corpus Christi as the fiscal officer for the project; and WHEREAS, the City Council desires to designate the City Manager as the responsible officer for the City for the project; and WHEREAS sthe City Council desires to authorize the City Manager to execute all documents necessary to obtain the surplus properties and wishes to authorize the City Manager to pay the administrative expenses incident to the transfer; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: 1JUt �LMED 4,5783 �_N my SECTION 1. That it is hereby determined that the City of Corpus Christi is eligible to receive Federal surplus properties from the General Services Administration through the Heritage Conservation and Recreation Services for developing Corpus Christi Tracking Station, Rodd Field, GSA Control Number 8000 - 19435, 126.97 acres, as an open space and recreation area. SECTION 2. That the City Manager is hereby designated as the responsible officer for the City for the aforesaid project. SECTION 3. That the City Manager is authorized to execute all documents necessary to obtain the surplus property. SECTION 4. That the City Manager is authorized to pay all adminis- trative expenses incident to the transfer of the surplus property. SECTION 5. That the Director of Finance is hereby designated as the fiscal officer for the project. SECTION 6. The necessity and urgency for immediate application for surplus federal properties from the General Services Administration through the Heritage Conservation and Recreation Service as promptly as possible creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ,7- day of 01— 7T qf/? 1978.
