HomeMy WebLinkAbout14595 ORD - 11/01/1978jkh;10- 31- 78;lst 4 AN ORDINANCE ABANDONING UTILITY EASEMENTS LOCATED WITHIN BLOCK 1, LOTS 1 AND 2, 4 AND 5, 6 AND 7, AND BLOCK 8, LOTS 1 AND 2, 4 AND 5, 7 AND 8, 12 AND 13, OF SHELTER BAY ESTATES, RECORDED IN VOLUME 41, PAGES 15 -18, MAP RECORDS OF NUECES COUNTY, TEXAS, SUBJECT TO THE RELOCATION BY THE PROPERTY OWNERS OF A 2 -INCH GAS LINE AND DEDICATION OF ALTERNATE EASEMENTS THEREFOR, RELOCATION OF ALL ELECTRIC LINES THAT MAY EXIST IN THE EASEMENTS BEING ABANDONED AND DEDICATION OF ALTERNATE EASEMENTS THEREFOR, AND RECORDING OF THE FINAL PLAT OF TURTLE COVE UNIT 3; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exist certain utility easements within Lots 1 and 2, 4 and 5, 6 and 7, Block 1, and in Lots 1 and 2, 4 and 5, 7 and 8, 12 and 13, of Block 8, Shelter Bay Estates, recorded in Volume 41, pages 75 -18, Map t Records of Nueces County, Texas, in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easements, subject to relocation of a two -inch gas line and dedication of alternate easement by the property owners; relocation of all electric lines which may exist in the easements being abandoned and dedication of alternate easements therefor; and recording of the final plat of Turtle Cove Unit 3: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the existing utility easements within Lots 7 and 2, 4 and 5, 6 and 7,,Block 1, and in Lots 1 and 2, 4 and 5, 7 and 8, 12 and 13, of Block 8, Shelter Bay Estates, recorded in Volume 41, pages 15 -18, Map Records of Nueces County, Texas, in the City of Corpus Christi, Nueces County, Texas, be and the same are hereby closed for public use and every municipal purpose, subject to the relocation by the property owners of a two -inch gas line and dedication of alternate easement therefor; relocation Nom¢ of all electric lines which may exist in the easements being abandoned and dedication of alternate easements therefor; and recording of the final plat of Turtle Cove Unit 3, said abandonment to the owners of the abutting property being in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easements creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this theJ4�_day of November, 1978.
