AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR CITY PARTICIPATION IN THE SIGNALI- ZATION OF SEVEN MAJOR INTERSECTIONS, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; APPROPRIATING $22,530 OUT OF THE NO. 220 STREET BOND FUND, APPLICABLE TO PROJECT NO. 220 -72 -14.5, TRAFFIC SIGNALIZATION AT THE FOLLOWING SEVEN LOCATIONS: I. Ayers and Santa Fe; 2. Morgan and Third; 3. Agnes and 19th- 4. Morgan and Santa Fe; 5. Shoreline and Kinney; 6. Agnes and Brownlee; and 7. Santa Fe and Elizabeth; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with the State Department of Highways and Public Transportation for City participation in the signalization of seven major intersections, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. That there is hereby appropriated out of the No. 220 Street Bond Fund the sum of $22,530, applicable to Project No. 220 -72 -14.5, Traffic Signalization at Seven Locations: I. Ayers and Santa Fe; 2. Morgan and Third; 3. Agnes and 19th; 4. Morgan and Santa Fe; 5. Shoreline and Kinney; 6. Agnes and Brownlee; and 7. Santa Fe and Elizabeth. SECTION 3. The necessity to authorize execution of the afore- said agreement and the appropriation of the necessary funds to accomplish the signalization at the described locations creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read 110RLMED FJUL 0 8190 14597 at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this theL4zt day of November, 1978. Party of the First Part, acting by and through its City Manager and the State of Texas, acting by and through the State Department of Highways and Public Transportation, hereinafter called the "State ", Party of the Second Part, made to become effective when fully executed by both parties: W I T N E S S E T H WHEREAS, Section 219 of the Federal -Aid Highway Act provides aid to projects for construction, reconstruction, and improvement of any off - system road, including, but not limited to, the correction of safety hazards, the replacement of bridges, the elimination of high- hazard locations and roadside obstacles; and WHEREAS, State funds are not eligible for expenditure on the project; and WHEREAS, Federal regulations require construction of such projects to be the responsibility of the State highway agency; and WHEREAS, the State and City each have indicated intention to proceed with the project; and WHEREAS, the State Highway and Public Transportation Commission has established Departmental policy and requires that for projects not a part of the State Highway System or the Federal -Aid System, funds required to match available Federal aid will usually be provided from sources other than the 1. "/71 `' State and such funds will be in the amount of 30% of the total estimated cost of the project including preliminary engineering, construction, con- struction engineering and contingencies and must be placed in escrow prior to commencement of project development; and WHEREAS, the City desires certain work as approved in the Statewide Highway Safety Improvement Program (Federal- Section 219) in accordance with the attached list marked "Ey.hibit A "; and WHEREAS, at least 30 days prior to scheduled letting or issuance of work order for state force account work the City upon request of the State Shall transmit a warrant or check made payable to the State Treasurer, Account of Trust Fund No. 927 in the amount of Twenty Two Thousand Five Hundred Thirty and No /100 Dollars ($22,530.00), which is 30 of the total estimated cost of the project including preliminary engineering, construction, construction engineering and contingencies. A 2.E E E M E N T NOW THEREFORE, it is agreed that the State will provide for said work and the City will upon request of the State at least 30 days prior to scheduled letting or issuance of work order for state force account work transmit to the State a warrant or check made payable to the State Treasurer, Account of Trust Fund No. 927 in the amount of Twenty Two Thousand Five Hundred Thirty and No /100 Dollars ($22,530.00), which is 30% of the total estimated cost of this project including preliminary engineering, construction, construction engineering and contingencies. If, during project development or construction or upon completion of the project, it is determined thst this amount is not sufficient to fulfill the City's responsibility, the City will, upon request of the 9-ate, supplement this amount by an amount equa} to the City's full estimated cost less the amount previously paid. In the event the amount as paid by the City is more than the City's respon- sibility, the excess amount will be returned to the City. In the event the 2. a • City desires to abandon the project prior to letting a contract for construction, the City "s responsibility for charges incurred for pre- liminary engineering will be deducted from the amount held in escrow and the remainder will be returned to the City.
