HomeMy WebLinkAbout14610 ORD - 11/08/1978jkh:11- 1- 78;lst �1 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE CORPUS CHRISTI.BALLET THEATRE BY THE TERMS OF WHICH THE CITY OF CORPUS CHRISTI WILL PAY $5,000 FOR A FREE COMPLETE PERFORMANCE OF THE "NUTCRACKER" BALLET TO BE PRESENTED DECEMBER 15, 1978 AND THE PRESENTATION OF PORTIONS OF THE BALLET TO SCHOOLS, LIBRARIES, AND OTHER LOCATIONS, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with the Corpus Christi Ballet Theatre by the terms of which the City of Corpus Christi will pay $5,000 for a free complete performance of the "Nutcracker" Ballet to be presented December 15, 1978 and the presentation of portions of the "Nutcracker" Ballet to schools, libraries,and other locations, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. The necessity to authorize execution of the agreement aforesaid at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of .its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the a g suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and that such ordinance take effect and be in full force and effec from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the _ _day of November, 19 ATTEST: City -Secretary MAYOR APPROVED: THE CITY OF COR HRISTI, TEXAS 1st DAY OF NOVEMBER, 1978: J. BRUCE AYCOCK, CITY ATTORNEY By ° Assistant C' ttorney 14610 AGREEMENT THE STATE OF TEXAS COUNTY OF NUECES II WHEREAS, the City of Corpus Christi is interested in providing expanded opportunities for its citizens to enjoy performances of the Corpus Christi Ballet Theatre; and WHEREAS, the Corpus Christi Ballet Theatre has agreed to provide a ballet performance with a special emphasis on making such performance available to the underprivileged; therefore, the following contract and agreement is entered into between the City of Corpus Christi and the Corpus Christi Ballet Theatre: The Corpus Christi Ballet Theatre agrees to provide: 1. A free complete performance of the traditional "NUTCRACKER" ballet on December 15, 1978 at 7:30 p.m. for those citizens who otherwise might not be able to afford to attend such a performance. 2. Ticket distribution for said performance on Friday, December 15, 1978 will be coordinated by the Board of Directors of the Corpus Christi Ballet Theatre to insure that a full house of approximately 2,500 will view the performance. Distribution of tickets by volunteers will be carried out at the Senior Citizens lunch programs, the Corpus Christi State School, city and school facilities in low- income areas, neighborhood centers, recreation centers, and handicapped programs. 3. The Ballet Theatre will reach an additional audience, primarily children and young people, by bringing mini - concerts, consisting of portions of the "Nutcracker" production, to schools, libraries, and other locations. 4. The Corpus Christi Ballet Theater will submit to the City a financial report of the receipts and expenditures of the total Nutcracker program for 1978 and a schedule of the auxiliary performances held with the attendance at each event. In consideration of the Corpus Christi Ballet Theatre's providing the above services, the City of Corpus Christi hereby agrees to pay to the Corpus Christi Ballet Theatre $5,000. Payment shall be made upon request Exg•'9" 0 by the Ballet Theatre. If the services required of the Ballet Theatre by this contract are not provided, the Ballet Theatre shall be liable for and repay to the City of Corpus Christi any money paid the Ballet Theatre by the City.
