HomeMy WebLinkAbout14613 ORD - 11/08/1978AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 61062 AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PORTION OF LOT 9, SECTION M, PAISLEY'S SUBDIVISION, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "I -2" LIGHT INDUSTRIAL DISTRICT TO - C ; KEEPING IN EFFECT ALL OTHER PRDVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council Its reports and recommendations concerning the application of City of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday November 8, 1978 l Specia at Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter Set out. SOU z SECTION 2. That the zoning of a portion of Lot 9, Section "M ", Paisley's Subdivision, known as the Old Incinerator Site, situated in the City of Corpus Christi, Texas, be and the same is hereby changed from "I -2" Light Industrial District to "A -2" Apartment House District, said portion being more particularly described as follows: BEING an irregularly shaped tract of land out of a portion of Lot 9, Section M, Paisley's Subdivision of the Hoffman Tract, as shown by map of record in Volume A, Page 28, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: BEGINNING at a point on the northeast right -of -way line of 50.0 foot wide Elgin Street, said point being the southwest corner of Lot 1, Block 1, La Gloria Addition, as shown by map of record in Volume 7, Page 46, Map Records, Nueces County, Texas, for the beginning paint of the tract of land herein described; THENCE North 88 100'00" East along the southeast boundary line of said La Gloria Addition, a distance of 405.87 feet to a point on the west right -of -way line of 60.0 foot wide Greenwood Drive; THENCE South 27 040'30" West along the west right -of -way line of said Greenwood Drive, a distance of 545.39 feet to a point being the northeast corner of Lot 9, Block 3, ,Leary Addition, as shown by map of record in Volume 9, Page 6, Map Records, Nueces County, Texas; THENCE North 62 °19'30" West along the north boundary line of said Leary Addition, a distance of 346.07 feet to a point on the east right -of -way line of above mentioned Elgin Street; THENCE North 27 °40'30 "East along the east right -of -way line of said Elgin Street, a distance of 332.77 feet to an interior angle point; THENCE North O1 °41'00" West continue along the east right -of -way line of said Elgin Street, a distance of 13.40 feet to the POINT OF BEGINNING and containing 3.551 acres, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from ACCORDINGLY SO ORDAINED, this the --I— day of- ATTEST: Caty Secretary MAYOR APPROVED: THE CITY DAY OF 24i�� , 19 ]k' J.
