Home My WebLink About14618 ORD - 11/15/1978t jkh;1O -10 -78 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE LEASE AGREEMENT AUTHORIZED BY ORDINANCE NO. 13992, PASSED AND APPROVED BY THE CITY COUNCIL ON OCTOBER 26, 1977, BETWEEN THE CITY OF CORPUS CHRISTI AND TEJAS AIRLINES, INC., COVERING RENTAL OF SPACE IN THE INTERNATIONAL ARRIVAL BUILDING AT CORPUS CHRISTI INTERNATIONAL AIRPORT, ALL AS MORE FULLY SET FORTH IN THE AMENDMENT TO THE LEASE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A ". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an amendment to the Lease Agreement authorized by Ordinance No. 13992, passed and approved by the City of Corpus Christi on October 26, 1977, between the City of Corpus Christi and Tejas Airlines, Inc., cover- ing rental of space in the International Arrival Building at the Corpus Christi International Airport, all as more fully set forth in the amend- P x ment to the Lease Agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". dMICROFILKA. 146 �JUL 0 81980 AMENDMENT TO LEASE AGREEMENT THE STATE OF TEXAS j COUNTY OF NUECES WHEREAS, by authority of Ordinance No. 13992, passed and approved by the City Council on October 26, 1977, City of Corpus Christi and Tejas Airlines, Inc., entered into a Lease Agreement covering subleasing of space at the Corpus Christi International Airport and the use of such airport for a term commencing on the 10th day of January, 1978, and termi- nating at the end of the 7th day of August, 1980, unless sooner terminated; _ and WHEREAS, it is mutually agreeable to the said parties that the aforesaid Lease Agreement be amended in the following particulars: 1. Add to ARTICLE I, PREMISES, paragraph C. Space in Terminal Building, a new paragraph, reading as follows: "Lessor hereby agrees to rent approximately 274 square feet of space to Lessee in the International Arrival Building at the Corpus Christi International Airport, for the period of October 8, 1978 through August 7, 1980, the portion to be rented being more fully shown on the attached map, marked Exhibit "A ", and made a part hereof. Lessee agrees to pay for the period of October 8, 1978 through August 7, 1979 the amount of $6.26 per square foot per year, and agrees to pay for all improvements and accepts the space on an as -is- basis. Rental after August 7, 1979, shall be at a rate determined annually by the following formula. Rental Rates in -the International Arrival Building were divided into three components as of March 1, 1977: Fuel, $1.62; Fixed, $1.46; and Other, $2.34; total $5.42}. Fuel Adjustment. The fuel cost of $1.62 will be computed by multiplying the $1.62 by a fraction the denominator of which shall be the cost for 1,000 cubic feet of gas paid by lessors at the Airport as of May, 1975, which was $1.728, and the numerator of which shall be the 12 -month average cost of gas from June through May of the appropriate year. i All Other Cost Adjustment. The rent shall be computed by multiplying by a fraction the denominator of which shall be the arithmetical average as of May, 1977 of the indices (A) of the United States Bureau of Labor Statistics for hourly wage rates of all production workers in manufacturing and (B) of the commodity wholesale price index and the numerator of which shall be the arithmetical average of said average indices (A) and (B) for the 12 -month period of June through May of the preceding year. The United States Bureau of Labor Statistics for hourly wage rates of all production workers in manufacturing as of May, 1975 is $4.75 and equals an index of 100. The Commodity Wholesale Price Index of May, 1975 was 183.8 (base year 1957 -59). Total Adjustment. The resultant rent will be the sum totals of recalculated cost of fuel, all other recalculated costs and the fixed cost." Except as herein and hereby amended, the terms, conditions, and provisions contained in the Lease Agreement aforesaid shall be and remain in full force and effect.
