HomeMy WebLinkAbout14621 ORD - 11/15/1978jkh:11- 15- 78;lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT FOR THE RENTAL OF THE TICKET OFFICE OF THE BAYFRONT PLAZA AUDITORIUM TO THE CORPUS CHRISTI AREA CONVENTION AND TOURIST BUREAU FOR $179 PER MONTH, ON A MONTH -TO -MONTH BASIS, NOT TO EXCEED SIX MONTHS, ALL AS MORE FULLY SET FORTH IN THE AGREE- MENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: ' SECTION 1. That the City Manager be and he is hereby authorized to execute a lease agreement for the rental of the ticket office of the Bay - front Plaza Auditorium to the Corpus Christi Area Convention and Tourist Bureau for $179 per month, on a month -to -month basis, not to exceed six months, all as more fully set forth in the agreement a substantial copy of which is attached hereto, marked Exhibit "A ", and made a part hereof. SECTION 2. The necessity to authorize execution of the aforesaid lease agreement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor,having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 16 day of November, 1978. Q r LEASE AGREEMENT STATE OF TEXAS COUNTY OF NUECES This agreement of lease by and between the City of Corpus Christi, a municipal corporation, herein designated as "Lessor" and the Corpus Christi Area Convention and Tourist Bureau, designated herein as "Lessee ", W - ITNES - SETH: That in consideration of the exchange of mutual covenants herein contained to be kept and performed on the part of Lessor and Lessee, the parties hereto agree as follows: 1. Lessor hereby leases and demises to Lessee the following described premises on the terms and conditions herein set forth, to -wit: One room designated as the ticket office, Bayfront Plaza Auditorium consisting of approximately 500 square feet of floor space. 2. Lessee shall occupy the leased premises for the sole purpose of conducting its convention sales and related administrative activities. 3. The term of said lease shall be one month, and may be renewed by mutual agreement on a month -to -month basis, subject however, to the right of Lessor to cancel said lease at any time upon Lessor giving Lessee thirty (30) days notice of such intention to terminate said lease. Lessee shall have the right to terminate said lease and vacate the premises at any time on written notice to Lessor. 4. By acceptance of this lease Lessee expressly agrees to indemnify and hold harmless the Lessor from any and all claims of damage or personal injury whatever that may arise as a result of Lessee's occupancy and use of the premises in any manner. 5. Lessee shall use and operate the premises substantially consistent with the use and operation of the Bayfront Plaza Auditorium, and shall cooperate in the joint use with other tenants of the ticket office and the use of the adjacent box office when requested by Lessor's Convention Center Manager, 6. Lessee shall observe reasonable standards of good house- keeping, and shall maintain the premises in good condition and in an attractive appearance. Lessee shall make no structural changes or alteration in the premises without prior written consent of Lessor. 7. Lessor shall provide at its expense all usual utility ser- vices used on the premises, except that Lessee shall provide telephone service. 8. Lessee shall pay the sum of $179 per month rent to Lessor, payable on the last day of the month. Payment shall be made to City of Corpus Christi, and delivered to Lessor's Convention Center Manager at the Bayfront Plaza Auditorium. Executed in duplicate originals this day of November, 1978.
