HomeMy WebLinkAbout14642 ORD - 12/06/1978F jkh; 12- 6- 78;lst AN ORDINANCE AMENDING ORDINANCE NO. 5096, PASSED AND APPROVED BY THE CITY COUNCIL ON JULY 16, 1958, AMENDED BY ORDI- NANCE NO. 5660, DATED FEBRUARY 3, 1960, WHICH PRO- VIDED FOR CLOSING OF A PORTION OF THE ALLEY THROUGH BLOCK 8, BROOKLYN ADDITION, AND ELM STREET FROM SURFSIDE BOULEVARD TO AVENUE "A ", BY AUTHORIZING THE CLOSURE OF THE SAID ALLEY AND SAID STREET TO ALL TRAFFIC AND REVERTING OWNERSHIP OF THE STREET AND ALLEY TO THE ABUTTING PROPERTY OWNERS; AND DECLARING AN EMERGENCY. WHEREAS, the City Council by Ordinance No. 5096, dated July 16, 1958, amended by Ordinance No. 5660, dated February 3, 1960, provided for closing a portion of the alley through Block 8, Brooklyn Addition, and Elm Street from Surfside Boulevard to Avenue "A" to vehicular traffic, save and except as to the reservation in the City as to Avenue A, the west 150 feet of Elm Street, and the alley in said Block 8, Brooklyn Addition; and WHEREAS, request has been made of the City Council for the closing of the alley in Block 8, Brooklyn Addition, and adjacent street to provide for expansion of business property by owners of abutting property; and WHEREAS, notice of the time and place for holding a hearing concern- ing the closing to vehicular traffic of the aforesaid alley in Block 8, Brooklyn Addition, Avenue A and the west 150 feet of Elm Street, situated in the City of Corpus Christi, Nueces County, Texas, was given by publication and mail to the last known address of the owners of property abutting said alley and streets, within the boundaries described hereinabove, and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting of the City Council of the City of Corpus Christi on Wednesday, November 22, 1978, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close to vehicular traffic the aforesaid alley in Block 8, Brooklyn Addition, Avenue A and the west 150 feet of Elm Street, and that the same revert to the abutting property owners: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: �0fILMEDj 14642 1 SECTION 1. That Ordinance No. 5096, dated July 16, 1958, amended by Ordinance No. 5660, passed and approved by the City Council on February 3, 1960, providing for closing a portion of the alley through Block 8, Brooklyn Addition, and Elm Street from Surfside Boulevard to Avenue "A" to vehicular traffic, save and except as to the reservation in the City as to Avenue A, the west 150 feet of Elm Street, and the alley in said Block 8, Brooklyn Addition, be and the same is hereby amended by authorizing closure of said alley and said street to all traffic and reverting ownership of the street and the alley to the abutting property owners. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the alley and the portion of public streets hereinabove more fully described creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the__� day of December, 1978.
