MARKED EXHIBIT "A "; AUTHORIZING THE CITY MANAGER TO(ACCEPT�;'A QUITCLAIM DEED FROM THE OWNERS OF THE MASTER HOST) INN, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "B "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be, and he is hereby, authorized and directed, for and on behalf of the City of Corpus Christi, to enter into an agreement with the;Exete�,Investmdeft" Company and Luxury Lodges, Inc., owners of the Master Host Inn concerning title and disposition of all improve- ments in a fishing pier south of the Master Host;,; Inn, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A "; that the City Manager is also hereby authorized and directed to,accept_`a Quitclaim Deed from the owners of the Master Host, ";Inn, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "B ". Said pier is more particularly,des,� c ed_as follows: A fishing pier, 300' in length, constructed of timber pilings, pre -case concrete deck sections and wooden handrails, located immediately northeast of the intersection of Coastal Avenue and North Shoreline Boulevard, and extending in a southeasterly direction from the south corner of Block Eight (8) Brooklyn Addition across Corpus Christi Beach into the waters of Corpus Christi Bay, as Block 8, Brooklyn is shown by plat recorded in Book A, Page 32, of the Map Records of Nueces County, Texas. SECTION 2. The necessity to accept the aforesaid Quitclaim Deed for the purposes therein described creates a public emergency and an impera- tive public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction ACROFIL ft . BRUCE AYCOCK, CITY ATTORNEY 8y �� Assistant Ci torney AGREDIENT THE STATE OF TEXAS X COUNTY OF NUECES f This agreement is authorized by Ordinance No. and is entered into between the City of Corpus Christi and Exeter Investment Company, a Texas Corporation, of the County of Angelina, State of Texas and Luxury Lodges, Inc., a Corporation of the County of Miller, State of Arkansas, and pertains to the interest in title and disposition of all improvements described as follows to wit: A fishing pier, 300' in length, constructed of timber pilings, pre -cast concrete deck sections and wooden handrails, located immediately northeast of the intersection of Coastal Avenue and North Shoreline Boulevard, and extending in a southeasterly direction from the south corner of Block Eight (8) Brooklyn Addition across Corpus Christi Beach into the waters of Corpus Christi Bay, as Block 8, Brooklyn is shown by plot recorded in Book A, Page 32, of the Map Records of Nueces County, Texas. NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: I. Exeter Investment Company and Luxury Lodges, the owners, agree to bargain, sell, release, and forever quitclaim unto the City of Corpus Christi all their rights, title, and interest in said improvements. 2. The City upon receipt of title in ownership agrees to remove the subject pier from the premises within 12 months from the date of acceptance of quitclaim deed. By Stern Feinberg, Sr., Yresident ATTEST: Secretary �� Q U I T C L A I M D E E D THE STATE OF TEXAS I KNOW ALL MEN BY THESE PRESENTS: COUNTY OF NUECES X THAT Exeter Investment Company, a Texas Corporation, of the County of Angelina, State of Texas, and Luxury Lodges, Incorporated, a corporation, of the County of Miller, State of Arkansas, for and in consideration of the sum of One and no /100 ($1.00) to each in hand paid by the City of Corpus Christi, a municipal corporation, of the County of Nueces and State of Texas, the receipt of which is hereby acknowledged, do by these presents BARGAIN, SELL, RELEASE, AND FOREVER QUIT CLAIM unto the said City of Corpus Christi, its successors, legal representatives and assigns, all their right, title and interest in and to all improvements situated on a certain tract or parcel of land lying in the County of Nueces, State of Texas, said improvements being described as follows to wit: A fishing pier, 300' in length, constructed of timber pilings, pre -cast concrete deck sections and wooden handrails, located immediately northeast of the intersection of Coastal Avenue and North Shoreline Boulevard, and extending in a southeasterly direction from the south corner of Block Eight (8) Brooklyn Addition across Corpus Christi Beach into the waters of Corpus Christi Bay, as Block 8, Brooklyn is shown by plot recorded in Book A, Page 32, of the Map Records of Nueces County, Texas. TO HAVE AND TO HOLD the said premises, together with all and singular the rights, privileges, and appurtenances thereto in any manner belonging unto the said City of Corpus Christi, its successors, legal representatives and assigns, forever, so that neither of the said grantors nor their successors, legal representatives or assigns, nor any person or persons claiming under any of them shall, at any time hereafter, have, claim, or demand any right or title to the aforesaid premises or appurtenances, or any part thereof. My Commission Expires Notary Public in and for Miller County, Arkan Corpus Christi, Tew _6 day of 19-2k TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
