HomeMy WebLinkAbout14653 ORD - 12/13/1978jkh:12- 13- 78;lst AN ORDINANCE CLOSING AND ABANDONING THE 5' x 130' UTILITY EASE- MENT OUT OF TRACTS 1 AND 2, BLOCK 1, PEARSON TRACT, RECORDED IN VOL. 44, PAGE 7, MAP RECORDS OF NUECES COUNTY, TEXAS, SITUATED IN CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO A REPLAT OF THE PROPERTY BY THE OWNERS; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 5' x 130' utility easement in Tracts 1 and 2, Block 1, Pearson Tract, as shown by plat recorded in Volume 44, page 7, Map Records of Nueces County, Texas, in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advanta- geous to the City of Corpus Christi to abandon said easement above described: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 5' x 130' utility easement in Tracts 1 and 2, Block 1, Pearson Tract, recorded in Vol. 44, page 7, Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to replatting of the property by the owners thereof, and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas, said easement being more fully described as follows: FIELDNOTE DESCRIPTION of a 0.015 acre, more or less, tract of land, being a 5 -foot utility easement located in Tracts 1 and 2, Block 1, Pearson Tract, as shown by plat recorded in Volume 44, Page 7, Map Records, Nueces County, Texas, and being more particularly described as follows: BEGINNING at the south corner of said Tract 2 for the south corner and POINT OF BEGINNING of this tract; THENCE N 61° 00' 00" W, along the southwest boundary line of said Tract 2, a distance of 5.00 feet to a point for the west corner of this tract; THENCE N 29° 00' 00" E, parallel to and 5,00 feet perpendicular therefrom the southeast boundary line of said Tracts 1 and 2, at 65.00 feet pass the common northeast boundary line of said Tract 2 and the southwest boundary line of said Tract 1, in all a distance of 130.00 feet to a point in the northeast boundary line of said Tract 1, for the north corner of this tract; THENCE S 610 00' 00" E, along said northeast boundary line of said Tract 1, a distance of 5,00 feet to a point being the east corner of said Tract 1, MICRO for the east corner of this tract; f A.0 THENCE S 290 00' 00" W, along the southeast boundary line of said Tra-� U 8 dy dU 1 and 2, at 65.00 feet pass the common south corner of'said Tract 1 an'� _the east corner of said Tract 2, in all a distance of 130.00 feet to the POINT OF BEGINNING. 1.4653 SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspen- sion of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /3 _day of December, 1978.
