HomeMy WebLinkAbout14663 ORD - 12/13/1978" 1 x AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICUALRLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF TONNIE SMETHERS BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT B, WESTERN HILLS UNIT 1, FROM R -1B ONE FAMILY DWE LING DISTRICT TO "B- NEIGHBOR- HOOD BUSINESS D STRICT, AND ON THE 5.1± ACRE TRACT OUT F SHARE 7,--HA RNEY PARTITION, MORE FULLY DESCRIBED R- E FAMILY DWELLING DISTRICT TO "R -2" MULTIPLE DWELLING DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Tonnie Smethers for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on _ Wednesday December 13, 1978 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the zoning of Tract B, Western Hills Unit 1, be and the same is hereby changed from "R -1B" One Family Dwelling District to "B -1" Neighborhood Business District and that the zoning of the following described 5.1± tract or parcel out of Share 7, Harney Partition, be and the same is hereby changed from "R -1B" One Family Dwelling District to "R -2" Multiple Dwelling District: Being 2.6 acres, more or less, out of Share 7, Harney Partition of the Gregorio Farias Grant, Nueces County Texas, and being more particularly described as follows: BEGINNING at the northwest corner of Lot 1, Block 1., Western Hills Unit One, as shown by map recorded in Volume 27, Page 46, Nueces County Map Records, said corner being the southwest corner and PLACE OF BEGINNING of this tract; THENCE North 37 °29' East, 313.92 feet to a point on the south right -of- way line of Leopard Street for the northwest corner of this tract; THENCE along the south right -of -way line of Leopard Street, South 56 °20'51" East, 240.87 feet to the northwest corner of Tract A, Western Hills Unit One, and a corner of this tract; THENCE along the boundary of said Tract A, South 37 °29'00" West, 125.00 feet; THENCE continuing along the boundary of Tract A, South 56 °20'51" East, 175.00 feet to a point on the west right -of -way line of Western Drive for a corner of Tract A and this tract; THENCE along siad west right -of -way line, South 37 029'00" West, 216.71 feet to a corner of Lot 5, Block 1, Western Hills Unit One, and the south- east corner of this tract; THENCE along the north boundary of Block 1, Western Hills Unit One, North 52 °31'00" West, 415.00 feet to the PLACE OF BEGINNING. and Being 2.5 acres, more or less, out of Share 7, Harney Partition of the Gregorio Farias Grant, Nueces County Texas, and being more particularly described as follows: BEGINNING at the northwest corner of Lot 1, Block 2, Western Hills Unit One, as shown by map recorded in Volume 27, Page 46, Nueces County Map Records, said corner being the southwest corner and PLACE OF BEGINNING of this tract; THENCE along the east right -of -way line of Western Drive, North 37 °29'00" East 222.07 feet to the southwest corner of Tract B, Western Hills Unit One, for a corner• of this tract; THENCE along the boundary of said Tract B, South 56 °20'51" East, 175.00 feet; THENCE continuing along the boundary of said Tract B, North 37 °29'00" East, 125.00 feet to a point along the south right -of -way line of Leopard Street for a corner of said Tract B, and this tract; THENCE along said south right -of -way line, South 56 °20'51" East, 168.31 feet to the northeast corner of this tract; THENCE South 37 °29'00" West, 410.00 feet to a corner of Lot 4, Block 2, Western Hills Unit One, and the southeast corner of this tract; THENCE along the north boundary of Block 2, Western Hills Unit One, North 45 °51'19" West, 344.87 feet to the PLACE OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and0fter its passage, IT IS ACCORDINGLY SO ORDAINED, this the 13 day of 1 tll,L 197y .
