Home My WebLink About14680 ORD - 12/20/1978jkh:12- 20- 78;lst 1 AN ORDINANCE ANNEXING A 26.3 -ACRE TRACT OF LAND, MORE OR LESS, REFERRED TO AS SARATOGA INDUSTRIAL PLACE, OUT OF LOT 1, SECTION 14, BOHEMIAN COLONY LANDS, MORE PARTICULARLY DESCRIBED HEREINAFTER BY METES AND BOUNDS, SITUATED IN NUECES COUNTY, TEXAS, PURSUANT TO ARTICLE 970a, V.A.C.S., TEXAS, AS AMENDED, AND CITY CHARTER, ARTICLE I, SECTION 2(b); PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, on the 6th day of December, 1978, a public hearing was duly held at the Regular Meeting of the City Council, following publication of due notice of said hearing in the official newspaper pursuant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of institution of proceedings for the annexation of a tract of land more fully described hereinafter, in Nueces County, Texas, at which all interested persons were afforded an opportunity to be heard, and by motion duly made, seconded and carried, the said hearing was closed on December 6, 1978; and WHEREAS, owner of the said land is desirous of contracting with the City for the annexation of said territory to the City of Corpus Christi; and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the afore- said area hereinafter more fully described: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the following described tract of land, as set forth in Exhibit "A" attached, being a copy of annexation contract between the City of Corpus Christi and Edgar Moore, is hereby annexed, said tract or parcel being more fully described as follows: �_ �CROF/LME� rJUL 0 81980 14680 Being a 26.3 acre tract of land, more or less, out of Lot 1, Section 14, Bohemian Colony Lands, a map of which is recorded in Volume A, page 48, Map Records of Nueces County, Texas: Beginning at the point of intersection of the west ri ht -of- way line of Chapman Ranch Road (State Highway No. 286 and the south line of said Lot 1 for the southeast corner of this tract from which corner the southeast corner of said Lot 1 bears South 610 32' 00" East 50.00 feet; Thence North 61° 32' 00" West, along the south line of said Lot 1, 923.73 feet, more or less, for the southwest corner of this tract; Thence North 290 00' 00" East 1260.00 feet, more or less, to a point on the south right -of -way line of Saratoga Boulevard (S.H. 357) for the northwest corner of this tract; Thence South 61° 32' 00" East, along said south right -of- way line of Saratoga Boulevard, parallel with the center- line thereof and 60.00 feet distant therefrom, measured at right angles thereto, 793.73 feet, more or less, for an angle point in said right -of -way and the northwest corner of this tract; Thence South 00° 02' 50" West, with the continuation right -of -way line of Saratoga Boulevard, 227.90 feet, more or less, to the point of intersection with said west right -of -way line of Chapman Ranch Road for a corner of this tract; Thence South 29° 00' 00" West, along the west right -of- way line of Chapman Ranch Road, 220.00 feet, more or less, for a corner of this tract; Thence continuing with said right -of -way, South 230 00' 00" West 201.00 feet, more or less, for a corner of this tract; Thence South 29° 00' 00" West, with the .west right -of -way line of Chapman Ranch Road, parallel to the centerline thereof and 50.00 feet distant therefrom, measured at right angles thereto, 640.00 feet, more or less, to the POINT OF BEGINNING. The above described area shall hereafter be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the City Charter of the City of Corpus Christi, and the ordinances, resolutions, laws, rules and regulations of the City of Corpus Christi, to, all intents and purposes as the present City of Corpus Christi is so subject, and subject to all the rights, privileges and burdens thereof. -2- SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, - phrase, word or provision, of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The necessity to immediately annex to the City of Corpus Christi the aforesaid land and to declare that the same shall hereafter be a part of the corporate limits of the City of Corpus Christi, creates a public emergency and an imperative public necessity requiringthe suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspen- sion of the Charter.rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this they D —_ day of December, 1978. That all of the above conditions shall be binding upon the successors and assigns of the said Owner and each of them, and shall consti- tute covenants running with the land.
