HomeMy WebLinkAbout14693 ORD - 01/03/1979RWC:jkh:12-14-78;1st AN ORDINANCE REPEALING ORDINANCE NO. 14589, DATED NOVEMBER 1, 1978; , AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. _6106, AS AMENDED, UPON APPLICATION OF JOHNNY WILSON, ET AL BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON ALL OF LOTS 16, 20, 24 AND 28, JOHNNY WILSON FARM LOTS , ANU A PURIIUN OF LOIS 8 AND 12, JOHNNY WILSON FARM LOTS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "F -R" FARM -RURAL DISTRICT TO "I-3" HEAVY INDUSTRIAL DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Jnhnny Wil»nn, at al, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, October 25, 1978 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens; and WHEREAS, Ordinance No. 14589, dated November 1, 1978, was adopted to effectuate such amendment to the Zoning Map; however, the description of the land was erroneously stated in said ordinance and it is now the desire of the City Council to correct such error by repealing Ordinance No. 14589: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 14589, dated November 1,X78 ,4e and the same is hereby repealed in its entirety. ,Lk/Vete/Lilt rt'UL 081980 14GD3 SECTION 2. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565, et seq, of the Ordinance adn Resolution Records, as amended from time to time, and in,particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the changes hereinafter set out. SECTION 3, That the zoning of the following described tract or parcel out of Lots 8 and 10, and all of Lots 16, 20, 24, and 28 of the Johnny Wilson Farm Lots, be and the same is hereby changed from "F -R" Farm -Rural District to "I-3" Heavy Industrial District: Description of a portion of Lots 8 and• 12, Johnny Wilson Farm Lots as recorded in Volume 21 at pages 12 and 13, Map Records, Nueces County, Texas: Beginning at a point in the west line of said Johnny Wilson Farm Lots, said point being S. 00° 06' W., 563.76' from the northwest corner of said subdivision; THENCE: East, a distance of 76.5 feet to the east line of a railroad easement; THENCE: S. 50° 56' 31" E, along new State Highway right- of-way called (S. 52° 23' 27" E) a distance of 236.21 feet to the point of curvature of a curve to the left; THENCE: Along said curve to the left, having a radius - of 3459.78 feet at 41.60 feet the south line of Lot 8 and the north line of Lot 12, in all a distance of 548.36 feet to the east line of Lot 12; THENCE: South with the east line of Lot 12, a distance of 75.64 feet to the southeast corner of Lot 12; THENCE: West with the south line of Lot 12, a distance of 712.70 feet to the subdivision west line; THENCE: N. 00° 06' E., a distance of 534.84 feet to the place of beginning and containing 5.2 acres of land, more or less. SECTION 4. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 5. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 7. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc— tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from a ACCORDINGLY SO ORDAINED, this the .5 day of ATTEST: ' 2 City'Secretary MAYOR APPROVED: DAY OF , 19-7 J.
