AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF
RANDAL STIVERS, JIM NIX AND JOE ADAME BY GRANTING A
SPECIAL COUNCIL PERMIT ON THE LAND AREA CONSISTING
OF 14.315+ ACRES AND BY CHANGING THE ZONING OF THE
WAItR AREA I,UNSISIING OF I2.3U3± ACRES, FROM "A-2"

DISTRICT, SAID AREA BEING ALL OF THE MOST SOUTHERLY
216.10± FEET OF LOT 2, LOTS 3 AND 4, C. G. GLASSCOCK ,,
BAY FRONT BAY ADDITION AND BOAT HARBOR, LOCATED ON THE
EAST SIDE OF OCEAN DRIVE NORTH OF COLE PARK, SITUATED
IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS,
AS MORE PARTICULARLY DESCRIBED ON THE SITE PLAN, A COPY
OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A", AND SUBJECT TO THE CONDITIONS
SET FORTH HEREINAFTER; KEEPING IN EFFECT ALL OTHER
PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of Randal Stivers,
Jim Nix and Joe Adame for amendment to the zoning map of
the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on December 20, 1978
, at
Special
Council Meeting of the
City Council in the Council Chamber at City Hall in the City of Corpus Christi;
and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendment would
best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, passed on the 27th day of August, 1937, appearing of record
14698
in Volume 9, pages 565, et seq, of the Ordinance and Resolution Records,
as amended from time to time, and in particular as amended by Ordinance
No. 6106, as amended, be and the same is hereby amended by making the changes
hereinafter set out.
SECTION 2. That the zoning of the water area, consisting of 12.303+
acres, out of the C.G. Glasscock Bay Front Bay Addition and Boat Harbor,
be and the same is hereby changed from "A-2" Apartment House District to
"B-2" Bayfront Business District, and that a Special Council Permit be granted
on the land area consisting of 14.315+ acres, the said areas being all of
the most southerly 216.10+ feet of Lot 2, Lots 3 and 4, C. G. Glasscock
Bay Front Bay Addition and Boat Harbor, located on the east side of Ocean
Drive north of Cole Park, situated in the City of Corpus Christi, Nueces
County, Texas. The said land area, consisting of 14.315+ acres, on which
Special Council Permit is granted, shall be subject to the conditions set
forth as follows:
1. That the "Minimum Depth of Front Yard in Feet"
contained in Article 24 for "B-2" Bayfront District
apply only to Structures two feet above the eleva-
tion of Ocean Drive and there be no signs within 20
feet of Ocean Drive.
2. That appropriate fire lanes as defined in Article 3
be provided from Ocean Drive to the Boat Basin.
3. That the Board of Adjustment have the right to hear
"Special Use Exceptions" as to Off -Street Parking
Requirements of the "B-2" Regulations, but no other
provision.
4. That Structures over two feet above the elevation of
Ocean Drive be oriented approximately perpendicular
to the seawall and Ocean Drive so as to provide at
least 18% space of the total Ocean Drive frontage of
the property included herein between buildings thus
creating visual corridors through the complex to Corpus
Christi Bay at Morgan and Elizabeth Streets.
5. That the 25% open space as applied to this project is
space suitable for recreation, gardens or patios.
Such space must be open to the sky, free of vehicular
traffic, parking and undue hazard, and readily access-
ible to all those for whom such space is designed to
serve. Such space may be the roof of any portion of
a building provided it is no higher than two feet above
the elevation of Ocean Drive.
6. That the standard screening fence requirment along the
south property line next to Cole Park be waived.
7. That this Special Permit shall be deemed to have expired
within five (5) years of the date of the granting of
the same unless the premises are actually being used
under said permit.

A copy of the site plan of the aforesaid properties is attached hereto and
made a part hereof, marked Exhibit "A".
In the event the Board of Adjustment grants any special exception
or variance to the Zoning Ordinance, applicable to the property included in
the Special Permit herein granted, other than the one specified herein, said
Special Permit will be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of
Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended
from time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That the necessity of immediately making aforesaid
change for the purpose of maintaining at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date of its introduc—
tion and that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared that such emergency
and necessity exist, and having requested the suspension of the Charter rule
and that this ordinance be passed finally on the date of its introduction and
take effect and be in full force and effect from a

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
