Home My WebLink About14707 ORD - 01/10/1979• HWG:j1(n:IZ-I4-78;1St AN ORDINANCE AMENDING THE LAND DRILLING ORDINANCE BY AMENDING SECTION 35-3 OF THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, ENTITLED "SAME --LAND DRILLING; FILING CASING PROGRAM," BY ADDING TO SAID SECTION NEW SECTION NUMBERS WHICH WILL REGULATE POR- TIONS OF PRODUCTION UNITS LYING INSIDE THE CORPORATE LIMITS OF THE CITY WHEN SUCH PRODUCTION UNITS ARE FORMED FOR WELLS DRILLED FROM SURFACE LOCATIONS OUT- SIDE THE CITY LIMITS BUT WITHIN 5,000 FEET OF THE CITY LIMITS; AMENDING SECTION 35-4, ENTITLED "SAME --WELLS ON LAND DEVIATING FROM VERTICAL," BY DELETING FROM SAID SECTION THE REFERENCE TO DIVISIONS THREE AND FOUR AND SECTIONS 35-97(c), 35-97(1) AND 35-100; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Land Drilling Ordinance of the City of Corpus Christi, appearing in Chapter 35 of the Code of Ordinances, City of Corpus Christi, 1976 Revision, be amended bending Section 35-3 of the said Code of Ordinances to hereafter read as follows: "Sec. 35-3. Same --Land drilling; filing casing program. "All of Sections 35-70, 35-121, 35-123 through 35-130, 35-132, 35-133, 35-138, 35-150, 35-171(b),35-172 and 35-173, of Article II, generally referred to as the 'Land Drilling Ordinance,' regulating the drilling opera- tions and conditions at the site of the drilling operations in land areas, are hereby made applicable to all drilling operations in land areas and Oso Bay areas outside of the city limits but within five thousand (5,000) feet of the city limits, as to all wells drilling after the adoption of ordinance No. 9346. Furthermore, before drilling operations are commenced on any well so located, the operator shall file with the city petroleum superintendent, for his approval, a casing program for such well, stating the location of such well. The failure to file with and'obtain the approval of the petroleum superintendent of the city of said casing program and the failure to follow such casing program or said Article II requirements, is hereby declared to create a nuisance and a violation of this Code." SECTION 2. That Section 35-4 of the said Code of Ordinances be and the same is hereby amended to hereafter read as follows: 14707 MICROFUI IIMFD JUL 0 81930 • "Sec. 35-4. Same --Wells on land deviating from vertical. "Wherever drilling or production operations commenced after the effective date of Ordinance No. 9346 are conducted at a land surface loca- tion outside the city limits, including Oso Bay areas, but within five thousand (5,000) feet of the city limits, where the well is intended to have a deviation from the vertical to the effect that the bottom of the hole, or some point between the surface location and the bottom of the hole, will be vertical from some point in the city limits, subject to the provisions of Article II, such operations shall be conducted in accordance with the provisions of Article II, generally referred to as the 'Land Drilling Ordinance,' except all of sections 35-97(d), 35-111, 35-113, 35-114, 35-137, 35-138, 35-140 through 35-144, and the amendments to said article regulating the drilling operations and conditions at the site of the drilling operations within the city limits, including the obtaining of a permit for such drilling operations, and the failure to observe any of said regulations is hereby declared to be a nuisance, and a violation of this Code." SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4.
