HomeMy WebLinkAbout14714 ORD - 01/10/1979vp:1/10/79:1st • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF THE CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOTS 3B, 4, 5, 5A, 6, 6A, 6B, 6C, 7, 7A, 7B, 7D, 7E, 8, 8B, 34, 35, 35B, 35E, 36, 36A, 36B, 37, 37D, 38A, 38B, 40A, 40B, 40C, 40E AND PORTIONS OF LOTS 1, 2, 3 AND 40, PATRICK GARDENS, MORE FULLY DESCRIBED HEREINBELOW, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "A-2" APARTMENT HOUSE DISTRICT TO "R -1B" ONE FAMILY DWELLING DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. • WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of City of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing ail persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance w•rith proper notice to the public, said public hearing having been held on January 3, 1979 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 14714 MICROFILMED • • SECTION 2. That the zoning on Lots 3B, 4, 5, 5A, 6, 6A, 6B, 6C, 7, 7A, 7B, 7D, 7E, 8, 8B, 34, 35, 35B, 35E, 36, 36A, 368, 37, 37D, 38A, 38B, 40A, 40B, 40C, 40E and portions of Lots 1, 2, 3 and 40, Patrick Gardens, being more fully described hereinbelow, situated in the City of Corpus Christi, Nueces County, Texas be changed from "A-2" Apartment House District to "R-18" One Family Dwelling District. Being a portion of Lots 1, 2 and 3, Patrick Gardens as recorded in Volume A, Page 47, Nueces County Map Records, Nueces County, Texas; BEGINNING at the northeast corner of Lot 4, such point also being the southeast corner of Lot 1; THENCE North 1°41' West for a distance of 183.75 feet to a point for corner; THENCE South 88°19' West for a distance of 150.00 feet to a point for corner; THENCE South 1°41' East for a distance of 108.75 feet to a point for corner; THENCE South 88°19' West for a distance of 150.00 feet to a point for corner, such point also being on the east right-of-way line of Cheyenne Street; THENCE South 1°41' East for a distance of 25.00 feet to a point for corner; THENCE North 88°19' East for a distance of 150.00 feet to a point for corner; THENCE South 1°41' East for a distance of 50.00 feet for a point for corner; THENCE North 88°19' East for a distance of 150.00 feet to the POINT OF BEGINNING, such area containing approximately 0.72 acre, more or less. Being a portion of Lot 40, Patrick Gardens as recorded in Volume A, Page 47, Nueces County Map Records, Nueces County, Texas; BEGINNING at a 3/4 -inch iron rod in the southwest corner of Lot 40-E, such point also being on the east boundary line of Lot 39-A; THENCE South 1°41' East for a distance of 50 feet to a 3/4 -inch iron rod; THENCE North 88°19' East for a distance of 100 feet to a point for corner, such point also bing on the west right- of-way line of Cheyenne Street; THENCE North 1°41' West for a distance of 50 feet to a point for corner; THENCE South 88°19' West for a distance of 100 feet to the POINT OF BEGINNING, such area containing approximately 0.11 acre of land, more or less. • • SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That. all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc— tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from anV after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /Q day of ��'� / , 19 7 ? .
