AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH CORPUS CHRISTI NATIONAL BANK WHEREBY THE CITY
AGREES TO REIMBURSE THE BANK FOR THE DEMOLITION OF
CURBS, GUTTERS, SIDEWALKS, AND DRIVEWAYS ON LAWRENCE
AND MESQUITE STREETS ABUTTING THE PARKING LOT OF THE
DRIVE-IN BANKING FACILITY BEING CONSTRUCTED BY SAID
BANK; APPROPRIATING $4,060 OUT OF THE NO. 220 STREET
BOND FUND APPLICABLE TO PROJECT NO. 220-72-64, CORNER
OF LAWRENCE AND MESQUITE, DEMOLITION OF CURBS, GUTTERS,
SIDEWALKS, AND DRIVEWAYS; AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement with Corpus Christi National Bank whereby the City
agrees to reimburse the bank for the demolition of curbs, gutters, sidewalks,
and driveways on Lawrence and Mesquite Streets abutting the parking lot of the
drive-in banking facility being constructed by said bank, all as more fully
set forth in the agreement, a substantial copy of which is attached hereto and
made a part hereof, marked Exhibit "A".
SECTION 2. That there is hereby appropriated the sum of $4,060
out of the No. 220 Street Bond Fund applicable to Project No. 220-72-64, corner
of Lawrence and Mesquite, demolition of curbs, gutters, sidewalks, and drive-
ways.
SECTION 3. The necessity to authorize execution of the aforesaid
agreement and to provide funds to effect the demolition hereinabove described
creates a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be passed
finally on the date of its introduction but that such ordinance or resolution
shall be read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity exist, having requested the suspension of
the Charter rule and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the Ay( day of January, 1979.

This agreement is entered into between the City of Corpus Christi, herein-
after called "City", and Corpus Christi National Bank in conjunction with
Bellows -Marshall, a joint venture, hereinafter referred to as "Bank".
INIEREAS, Bank is in the process of constructing a drive-in banking facility
in the downtown area of Corpus Christi, Texas, bounded by Lawrence Street on
the South, Mesquite Street on the East, Schatzell Street on the North and the
City Tax Office on the West; and
WBEREAS, the construction of said drive-in banking facility requires the
demolition of curbs, gutters, driveway entrances, and sidewalks for the parking
area at the corner of Lawrence and Mesquite Streets:
NOW, TBEREFORE, for and in consideration of the exchange of mutual covenants
herein contained to be kept and performed, the City and the Bank agree as follows:
1. The Bank will demolish, or cause to be demolished, the said curbs, gutters,
driveway entrances and sidewalks which abut the drive-in banking facility on
Lawrence and Mesquite Streets and will reconstruct such improvements in accordance
with City specifications for the use of the public.
2. The City agrees to reimburse the Bank a total of Four Thousand and
Sixty ($4,060.00) Dollars for the actual cost of the demolition of said curbs,
gutters, driveway entrances and sidewalks as invoiced by Bellows -Marshall, the
contractor performing the construction of the facility, upon completion of demoli-
tion, reconstruction, and acceptance by the City of said items.
3. The Bank agrees to indemnify the City against all claims arising as a
result of this project.

4. This agreement shall become effective and shall be binding upon and
shall inure to the benefit of the parties hereto and their respective successors
and assigns from and after the date of execution.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
