HomeMy WebLinkAbout14738 ORD - 01/24/1979Jkh:1-23-79;lst AN ORDINANCE AMENDING ORDINANCE NO. 14671, PASSED AND APPROVED BY THE CITY COUNCIL ON DECEMBER 20, ,J978 WHICH AUTHORIZED EXECUTION OF AN ESCROW AGREEMENT WITH THE STATE DEPART- MENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR CONSTRUC- TION OF STREET AND SANITARY SEWER IMPROVEMENTS TO PORT AVENUE, FROM S.H. 286 (CROSSTOWN) TO AYERS STREET, BY REVERTING ALL APPROPRIATIONS MADE BY THIS ORDINANCE AND REAPPROPRIATING FUNDS AS FOLLOWS: $230,809 OUT OF THE NO. 220 STREET BOND FUND, PROJECT NO. 220-77-1, PORT AVENUE IMPROVEMENTS, CROSSTOWN TO AYERS, AND $207,941 OUT OF THE NO. 250 SANITARY SEWER BOND FUND, PROJECT NO. 250-77-8, PORT AVENUE MAIN REPLACEMENT, CROSSTOWN TO HORNE, FOR A TOTAL APPROPRIATION OF $438,750; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE ORDINANCE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: • SECTION 1. That Ordinance No. 14671, passed and approved by the City Council on December 20,1978 which authorized execution of an Escrow Agreement with the State Department of Highways and Public Transportation for construction of street and sanitary sewer improvements to Port Avenue, from S.H. 286 (Crosstown) to Ayers Street, be amended by reverting all appropri- ations made by the said ordinance and in lieu thereof, reappropriating funds as follows: $230,809 out of the No. 220 Street Bond Fund, Project No. 220-77-1, Port Avenue Improvements, Crosstown to Ayers, and $207,941 out of the No. 250 Sanitary Sewer Bond Fund, Project No. 250-77-8, Port Avenue Main Replacement, Crosstown to Horne, for a total of $438,750. SECTION 2. Except as hereinabove provided, the provisions and terms of Ordinance No. 14671 shall be and remain in full force and effect. SECTION 3. The necessity to amend Ordinance No. 14671 so as to reappropriate funds for construction of street and sanitary sewer improve- ments to Port Avenue, as hereinabove set forth, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and 1473 MICROFII .0_ 0a "9" • • after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 4f -day of January, 1979.
