HomeMy WebLinkAbout14754 ORD - 01/31/1979JKH:hb:1/30/79 • • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CLIFF ZARSKY-TEXAN HOMES, INC. BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACTS A AND B, OUT OF LOTS 3 AND 4, SECTION 19, (38.3tACRES), FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "F -R" FARM -RURAL DISTRICT TO."R-1B" ONE -FAMILY DWELLING DISTRICT FOR TRACT A AND "R-2" MULTIPLE DWELLING DISTRICT FOR TRACT B; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES.IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Cliff Zarsky-Texan Homes, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 31, 1979 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 1475 MICROFILMED lir :jut 08198O • SECTION 2. That the zoning on Tracts A and B, out of Lots 3 and 4. Section 19, (38.3± acres), Flour Bluff and Encinal Farm and Garden Tracts, situated in the City of Corpus Christi, Nueces County, Texas, and more particularly described as follows: TRACT A BEGINNING at the intersection of the Westerly boundary line of Lot 3 and the Southerly right-of-way line of the Naval Air Station Railroad for the Northwest corner and Point of Beginning of this tract; THENCE South 29° West along said Westerly boundary line 1,263', more or less, to the Northerly .boundary line of a 75' wide easement for drainage for the Southwest corner of this tract; THENCE South 61° East along said boundary to the Easterly boundary line of Lot 4 for the tract; THENCE North 29° East along said boundary to the Northeast corner of this tract; THENCE North THENCE North THENCE North THENCE South THENCE North THENCE North THENCE South THENCE North right-of-way line tract; line 1,320', more or less, Southeast corner of this line 1,078', more or less, 61° West 130', more or less, to a corner; 29° East 30', more or less,to a corner; 62° West 130', more or less, to a corner; 29° West 572', more or less, to a corner; 61° West 540', more or less, to a corner; 29° East 567', more or less, to a corner; 61° East 110', more or less, to a corner; 6° East 270', more or less, to a point in the Southerly of said Naval Air Station Railroad for a corner of this THENCE North 61° West along said right-of-way line 570', more or less, tothePOINT OF BEGINNING. TRACT B BEGINNING at the intersection of the easterly boundary line of Lot 4 and the southerly right-of-way line of the Naval Air Station Rail- road for the Northeast corner and Point of Beginning of this tract; THENCE South 29° West along said Easterly boundary line 185 feet to a corner; THENCE North 61° West 130',more or less, to a corner; Thence North 29° East 30', more or less, to a corner; THENCE North 61° West, 130', more or Iess, to a corner; THENCE South 29° West 572', more or less, to the Southeast corner of this tract; THENCE North of this tract; THENCE North 29° East 567', more or less, to a corner; 62° West 540', more or less, to the Southwest corner THENCE South 61° East 110', more or less, to a corner; -2- • THENCE North 6° East 170', more or less, to a point in the Southerly right-of-way line of said Naval Air Station Railroad for the Northwest corner of this tract; THENCE South 61° East along said right-of-way line 750', more or less, to the POINT OF BEGINNING, be and the same is hereby changed from "F -R" Farm -Rural District to "R -1B" One -Family Dwelling District for Tract A and "R-2" Multiple Dwelling District for Tract B. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this theL3/ day of �A�.4 46y, , 19 V ATTEST: iCtySecretary % APPROVED: .50 DAY OF J.
