KOCH, PSYCHOLOGIST, FOR PSYCHOLOGICAL SERVICES IN REGARD TO THE POLICE ADMINISTRATION PSYCHOLOGICAL ASSISTANCE GRANT, ALL AS MORE FULLY SET FORTH IN THE CONTRACT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a contract with Dr. M.D. Koch, Psychologist, for psychological services in connection with the Police Administration Psychological Assistance Grant, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to authorize execution of the aforesaid contract at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /`f day of Febr ary, 1979. BRUCE AYCOCK, CITY ATTORNEY By Assistant Cit _ MAYOR % _ THE CI OF CO?:- HRISTI, TEXAS 14766 MICROFILMED `.AUL 08 THE STATE OF TEXAS COUNTY OF NUECES CONTRACT AND AGREEMENT FOR PROFESSIONAL SERVICES KNOW ALL MEN BY THESE PRESENTS: • This contract is made, entered into and executed by and between the City of Corpus Christi, a municipal corporation situated in Nueces County, Texas, acting through its duly authorized officers, hereinafter referred to as the "City", and Dr. M. G. Koch, 4517 S. Staples, Corpus Christi, Texas, hereinafter referred to as "Psychologist". The City and the Psychologist in consideration of the mutual covenants and agreements contained herein do mutually agree as follows: Psychologist shall provide the services and material described in Exhibit "A" (attached hereto and made a part hereof for all purposes) up to the maximum hours and dollars noted for each category, as directed by the Police Chief according to the requirements of the Police Department. City does not guarantee to Psychologist the maximum hours noted in Exhibit "A", but only those up to the maximum which are determined to be necessary by the Police Chief. All services shall be provided at the rate of $16.88 per hour. Psychologist shall perform all services in a professional manner. All matters not covered in detail shall be performed in a manner consistent with the standards now prevailing in the discipline of professional psychology. II This contract shall be effective as of the date of its execution by the parties and shall terminate one year from date of execution. The times and dates services are actually performed shall conform to the reasonable needs of the Police Department as determined by the Police Chief. Records shall be kept and maintained in a professional manner by Psychologist documenting hours worked and detailing services rendered. Time sheets containing such information shall be presented by Psychologist to City on a monthly basis, and payment shall be made by City on a monthly basis at the rate of $16.88 per hour. No services or fee shall exceed the maximum v.x ate �L provided in Exhibit "A" for each category of services. Provided, however, that the Police Chief may authorize transfer of hours from one category to another. In no event, however, shall services be rendered in excess of the maximum contract price of $22,640 without prior approval by the Corpus Christi City Council. III ' This contract shall not be assignable by either party without the prior written consent of the other party. Written consent on behalf of the City shall require consent in the form of Counci] Motion, Resolution, or Ordinance. IV If any provision of this contract is declared or found to be illegal, unenforceable at law or. void, then neither party hereto shall be relieved of all obligations arising under the contract, and if capable of performance, the remainder of the contract shall not be affected thereby. V All amounts due hereunder and all obligations performed here- under should be paid and performable in Nueces County, Texas, and all questions arising under this contract shall be construed and resolved in the course of the laws of the State of Texas. VI Except as may otherwise be provided herein, this contract shall be subject to amendment only with the mutual consent of.the parties hereto. VII This contract may be terminated for convenience by either party at any time by notice in writing to the other party at least ten (10) days prior to the undertaking of services under this contract and agreement. VIII This contract in no way affects Psychologist's obligations to comply with all applicable laws, ordinances and codes of the Federal, State and local governments. IX All powers not explicitly vested in Psychologist by this contract remain with the City. -2- IN TESTIMONY OF WHICH this contract has been executed by the Psychologist and has been executed on behalf of the City by its authorized officials on the dates shown below, in duplicate originals, both of equal force. Admin- istering tests, scoring tests, consulting with trainees as to significance of testing. Preparation of written reports concerning evaluations of testing and prelimin- ary data on applicant profiles, maximum of 230 hrs. at $16.88 per hour $ 3,880 II. Disciplinary Process Interviewing and counseling officers regarding their reaction to internal disciplinary processes, and pro- viding management consultation regarding the apparent value of the processes as related to the overall effectiveness in correcting unacceptable behavior. Maximum of 240 hours @ $16.88 per hour 4,050 III. Family Counseling Affording counseling services on strictly voluntary basis to those officers and their families experiencing personal problems related to job stresses, both on and off duty, and personal relationships in marital problems, maximum of 746 hours at $16.88 per hours 12,600 IV. Promotions and Assignments Interviewing and testing officers to determine suitability for promotions or assignments. Preparation of and evalu- ation of testing results. Completing written reports as required, maximum of 53 hours at $16.88 per hour 900 V. Major Crime Cases Advising and counseling police invewtigators on criminal profiles for major crime incidents, maximum of 30 hours at $16.88 per hour 500 TOTAL PROFESSIONAL SERVICES $21,930 VI. Supplies and Direct Operating Expenses Copyrighted testing material for use by Psychologist.
