AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER OF
AGREEMENT WITH BONNER MC LANE ADVERTISING, INC. OF
CORPUS CHRISTI FOR INDUSTRIAL DEVELOPMENT ADVERTIS-
ING; AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute a letter of agreement with Bonner McLane Advertising, Inc. of
Corpus Christi for industrial development advertising, a substantial copy of
which is attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. That the necessity to execute the aforesaid letter of
agreement so that the advertising program may commence at the earliest prac-
ticable date creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordi-
nance or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared such emergency and necessity to exist, and
having requested the suspension of the Charter rule and that this ordinance be
passed finally on the date of its introduction and take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED

LETTER OF AGREEMENT

THIS AGREEMENT, made and entered into this 5th day of September, 1978,
by and between Corpus Christi Industrial Commission, hereinafter known
as client, and Bonner McLane Advertising, Inc., Corpus Christi, herein-
after known as agency, becomes effective September 11, 1978.
Agency will:
A. Maintain budget and place all media advertising subject to normal
15% agency commission with client's prior approval. Copy and
layout will be charged for at normal man-hour rates.
B. Create copy and graphic themes for media advertising and merchan-
dising materials (leaflets, brochures, direct mail, etc.).
C. Act in a consultancy capacity in areas of public relations, compen-
sation for which will be charged at the rate of $25 per hour for
account man, $15 per hour for writers (subject to prior approval
by both parties).
D. Artwork/photography/typeset and talent charges will be billed on
a per -job basis with prior approval by client. These outside
charges are billed on invoice from supplier. Production charges
are billed on invoice from supplier. Production charges are
routinely charged out as follows:
1. Art/layout: $25 per hour depending on style.
2. Radio/TV direction $20 per hour, production $120 per day.
3. Publicity releases for special projects are charged out
on a $25 per hour basis-- (no guarantee is made for pub-
lication) plus photography when required. Prior approval
by client.
E. All out-of-pocket costs for freight, postage, telephone, photo
copies, etc. are billed at agency's cost.
F. Complete billing will be furnished to client no later than the 9th
of each month, with payment due to agency by the 20th of that
month. A 2% discount is allowed on media when bill is paid by 20th.

G. This letter of agreement is subject to cancellation by either
party upon 30 days prior written notice. Contract may be re-
viewed by either party annually with request for changes to be
given by June 1, to be effective from July 1 following.

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
