AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH
E. J. NETEK FOR THE CONSTRUCTION OF THE SIDEWALK IMPROVE-
MENTS ALONG BEAR LANE AND OLD BROWNSVILLE ROAD IN THE
AREA OF THE CASA DE MANANA APARTMENTS; APPROPRIATING
$27,000, OF WHICH $10,954.17 IS OUT OF THE NO. 220 STREET
BOND FUND AND $16,045.83 IS OUT OF THE N0. 162 FEDERAL/STATE
GRANTS FUND, ACTIVITY 4741, CODE 502, FOURTH YEAR COMMUNITY
DEVELOPMENT BLOCK GRANT, OF WHICH AMOUNT $22,663.59 IS FOR
THE CONSTRUCTION CONTRACT AND $4,336.41 IS FOR ADDITIONAL
ENGINEERING, LEGAL ADVERTISING, CONTINGENCIES, INCIDENTAL
AND RELATED EXPENSES, APPLICABLE TO PROJECT NO. 220-77-2.5,
CASA DE MANANA AREA SIDEWALK IMPROVEMENTS; AND DECLARING
AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute a contract with E. J. Netek for the construction of the sidewalk
improvements along Bear Lane and Old Brownsville Road in the area of the
Casa de Manana Apartments, all as more fully described in the plans and
specifications and contract documents on file in the office of the City
Secretary, all of which are made a part hereof by reference and according
to the bid of E. J. Netek, opened on the 21st day of February, 1979, said
bid being the lowest and most advantageous to the City of Corpus Christi.
SECTION 2. That there is hereby appropriated the sum of $27,000,
of which $10,954.17 is out of the No. 220 Street Bond Fund and $16,045.83
is out of the No. 162 Federal/State Grants Fund, Activity 4741, Code 502,
Fourth Year Community Development Block Grant, of which amount $22,663.59 is
for the construction contract and $4,336.41 is for additional engineering,
legal advertising, contingencies, incidental and related expenses applicable
to Project No. 220-77-2.5, Casa de Manana Area Sidewalk Improvements.
SECTION 3. That the necessity to execute the aforesaid contract
and to appropriate the sums hereinabove set forth in order that construc-
tion of the aforesaid sidewalk improvements may be commenced at the earliest
practicable date creates a public emergency and an imperative public neces-
sity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction but such

ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor, having declared such emergency and necessity
to exist, having requested the suspension of the Charter rule and that
this ordinance be passed finally on the date of its introduction and take
effect and be in full force and effect from and after its

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
