AN ORDINANCE
AMENDING ORDINANCE NO. 14571, PASSED AND APPROVED BY
THE CITY COUNCIL ON OCTOBER 25, 1978, SO AS TO ADD
TO THE PORTIONS OF JOHANNA STREET CLOSED BY SAID
ORDINANCE A 2500 -SQUARE FOOT PORTION ABUTTING LOTS
B-1 AND B-2, BOULEVARD ACRES, AS MORE FULLY SET FORTH
HEREINAFTER; AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing
concerning the closing of a portion of Johanna Street, situated in the
City of Corpus Christi, Nueces County, Texas, was given by publication and
mail, as required by law, and said public hearing was held at Regular
Council Meeting of the City Council on October 11, 1978, in accordance
with the provisions of the City Charter; and
WHEREAS, by the passage of Ordinance No. 14571, the City Council
approved the closing of portions of Johanna Street, located generally
between Kostoryz Road and Richter Street and adjacent to the proposed Ventura
Plaza Unit 5 Subdivision, and approved reversion of the same to the abutting
property owners; and
WHEREAS, the description of the portion of Johanna Street proposed
to be closed inadvertently failed to include a portion of said street to
be closed, and the City Council desires to correct said description by
including that portion more fully set forth hereinafter:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That Ordinance No. 14571, passed and approved by
the City Council on October 25, 1978, be and the same is hereby amended by
adding the hereinafter described portions of Johanna Street to be closed
and to revert to the abutting property owners:
Fieldnotes for the closure of Johanna Street adjacent
to Lots B1 and B2 in Boulevard Acres, a map of which is
recorded in Volume 37, page 68, Map Records of Nueces
County, Texas:
Beginning at the West corner of Lot B1, said Boulevard
Acres for the North corner of this tract;
Thence South 61° 33' 00" East 100.00 feet and the South
Corner of Lot B2 for the East corner of this tract;

Thence South 29° 00' 00" West 25.00 feet for the
South corner of this tract;
Thence North 61° 33' 00" West 100.00 feet for the
West corner of this tract;
Thence North 29° 00' 00" East 25.00 feet to the
POINT OF BEGINNING containing 2,500 square feet of
land.
SECTION 2. Except as herein and hereby amended, the terms
and conditions of Ordinance No. 14571 shall be and remain in full force and
effect.
SECTION 3. The necessity to correct the portion of Johanna Street
purported to be closed by authority of Ordinance No. 14571 creates a public
emergency and an imperative public necessity requiring the suspension of the
Charter rule that no ordinance or resolution shall be passed finally on the
date of its introduction but that such ordinance or resolution shall be
read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, and having requested the
suspension of the Charter rule and that this ordinance be passed finally on
the date of its introduction and take effect and be in full force and effect
from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 40
day of 1979.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
