AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH
CLAUDE CHAPMAN CONSTRUCTION COMPANY, INC., FOR CONSTRUC-
TION OF THE HIGHWAY 9 SANITARY SEWER IMPROVEMENTS;
APPROPRIATING $200,000 OUT OF THE NO. 250 SANITARY SEWER
BOND FUND, OF WHICH $181,471.50 IS FOR THE CONSTRUCTION
CONTRACT, $6,500 IS FOR ADDITIONAL ENGINEERING, AND
$12,028.50 IS FOR LEGAL ADVERTISING, INCIDENTAL AND
RELATED EXPENSES, APPLICABLE TO PROJECT NO. 250-77-9,
HIGHWAY 9 - CORN PRODUCTS ROAD LIFT STATION AND LATERALS;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:

SECTION 1. That the City Manager be and he is hereby authorized
to execute a contract with Claude Chapman Construction Company, Inc., for
construction of the Highway 9 Sanitary Sewer Improvements, all as more
fully described in the plans and specifications and contract documents on
file in the office of the City Secretary, all of which are made a part
hereof by reference and according to the bid of Claude Chapman Construction
Company, Inc., opened on the 21st day of February, 1979, said bid being the
lowest and most advantageous to the City of Corpus Christi.
SECTION 2. That there is hereby appropriated out of the No.
250 Sanitary Sewer Bond Fund the sum of $200,000, of which amount $181,471.50
is for the construction contract, $6,500 is for additional engineering, and
$12,028.50 is for legal advertising, incidental and related expenses,
applicable to Project No. 250-77-9, Highway 9 - Corn Products Road Lift
Station and Laterals.
SECTION 3. That the necessity to execute the aforesaid contract
and to approriate the sums hereinabove set forth in order that the construc-
tion of the said sanitary sewer improvements may be commenced at the earliest
practicable date creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordi-
nance or resolution shall be read at three several meetings of the City
Council, and the Mayor, having declared such emergency and necessity to
exist, having requested the suspension of the Charter rule and that this

ordinance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS ACCORDINGLY

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
