HomeMy WebLinkAbout14804 ORD - 02/28/1979hb:2/27/79 • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORIDNANCE NO. 6106, AS AMENDED, UPON APPLICATION OF VIOLET DEVELOPERS, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACTS A, B, AND C, OF THE JOHN KOCUREK TRACT, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "F-R"FARM-RURAL DISTRICT TO "R -1B" ONE -FAMILY DWELLING DISTRICT FOR TRACT A, 62.90± ACRES; "A-1" APARTMENT HOUSE DISTRICT FOR TRACT B, 7.36± ACRES; AND "R-2" MULTIPLE DWELLING DISTRICT FOR TRACT C, 7.71+ ACRES; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND DECLARING AN EMERGENCY. • WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Violet Developers for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, February 28, 1979 . at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 14804 JUL 0 S 0980 SECTION 2. That the zoning on Tracts A, B, and C, John Kocurek Tract, situated in the City of Corpus Christi, Nueces County, Texas, and more fully described as follows: TRACT A Beginning at a point in the northwest right-of-way line of Violet Road, said point being the easternmost corner of Lot 2 Kocurek Estates as shown by plat recorded in Volume 32 Page 161 of the Map Records of Nueces County, Texas for the southernmost corner of this tract; Thence N53°06'047W 257.61 feet along the common boundary line of this tract and said Lot 2, Kocurek Estates to the most northerly corner of said Lot 2 and an interior southern corner of this tract; Thence continuing along said common boundary line S36°53'56"W 174.69 feet to the most westerly corner of said Lot 2 for a southerly corner of this tract; Thence N53°20'32"W 1,949.67 feet to a point for the most west- erly corner of this tract; said point being in the southeast boundary line of Tract I Harney Partition as described by plat recorded in Volume 6 Page 29 of the Map Records of Nueces County, Texas;' Thence N37°26'12"E 2,029.58 feet along the common boundary line of this tract and said Harney Partition to a point for the north- ernmost corner of this 'tract, said point also being a western corner of Tract 1 of the C.C. Hart Partition as described in Volume 293 Page 425 of the Deed Records of Nueces County, Texas; Thence S53°18'27"E 167.75 feet to a point for a northern corner of this tract, saidpointalso being in the boundary line of said Tract I Hart Partition and in the boundary line of a tract belonging to the Calallen School District as described by deed recorded in Volume 894 Page 200 of the Deed Records of Nueces County, Texas Thence 536°41'07"W 559.97 feet to a point for the most westerly corner of said Calallen School Tract for an interior northerly corner of this tract; Thence S53°17'31"E 757.69 feet along the common boundary line of this tract and said Calallen School tract to a point for a northeastern corner of this tract; Thence S36°42'29"W 130.00 feet to a point for an interior easterly corner of this tract; Thence S53°17'31"E 223.70 feet to a point for an easterly corner of this .tract; Thence S5°05'52"W 152.94 feet to a point for an interior easterly corner of this tract; Thence S53°19'35"E 525.96 feet to a point in the centerline of a 30.00 foot Seadrift Pipe Line Easement, as shown by deed recorded in Volume 594 Page 588 of the Deed Record of Nueces County, Texas; Thence S44°41'29"W 565.53 feet along the centerline of said easement to a point for an interior southerly corner of this tract; -2- • Thence S53°19'35"E 570.38 feet to a point. in the northwest right- of-way line of Violet Road, for the easternmost corner of this tract; Thence along said northwest right-of-way line of Violet Road 545008'55"W 408.63 feet to the point of curvature of a circular curve to the left whose central angle is 09036'06" whose radius is 418.82 feet whose tangent. is 35.18 feet for a southerly corner of this tract; Thence along the arc of said circular curve to the left, a distance_of 70.19 feet to the POINT OF BEGINNING. TRACT B Beginning at a point in the northwest right-of-way line of Violet Road from whence the southernmost corner of Lot 8, Kocurek Estates as shown by plat recorded in Volume 38 Page 163 of the Map Records of Nueces.County, Texas bears N45°08'55"E 262.83 feet along -said right-of-way line for the easternmost corner of this tract; Thence along said right-of-way line S45°08'55"W 566.35 feet to a point for the -southernmost corner of this tract; Thence N53°19'35"W 570.38 feet to the centerline of a 30 foot Seadrift Pipe Line Easement described in Volume 594 Page 588 of the Deed Records of Nueces County, Texas for the westernmost corner of this tract; Thence along the centerline of said easement N44°41'29"E 565.53 feet to a point for the northernmost corner of this tract; Thence S53°19'35"E 575.04 feet to the POINT OF BEGINNING. TRACT C BEGINNING at a point in the northwest right-of-way line of Violet Road, said point being the southernmost corner of Lot 8 Kocurek Estates as shown by plat recorded in Volume 38 Page 163 of the Map Records of Nueces County, Texas for the eastern- most corner of this tract; Thence S45°08'55"W 262.83 feet along Said northwest right-of- way line of Violet Road to a point for the southernmost corner of this tract; Thence N53°19'35"W 1,100.00 feet to a point fpr a westerly corner of this tract; Thence N5°05'52"E 152.94 feet to a point for an interior westerly corner of this tract; Thence N53017'31"W 223.70 feet to a point for the westernmost corner of this tract; Thence N36°42'29"E 130.00 feet to a point in the common boundary line of this tract and tract belonging to the Calallen Independent School District as described by deed recorded in Volume 894 Page 200 of the Deed Records of Nueces County, Texas for the northern- most corner of this tract; -3- • • Thence S53°17'31"E 400.00 feet to a point in the southeast right-of-way line of Hilltop Drive, said point also being the most westerly corner of Lot 3 Kocurek Estates as described by plat recorded in Volume 3 Page 104 of the Map Records of Nueces County, Texas; Thence S53°19'35"E 824.50 feet along the common boundary line of this tract and said Lot 3 Kocurek Estates to a point for the southernmost corner of said Lot 3 said point also being the westernmost corner of said Lot 8 Kocurek Estates; Thence S53°15'58"E 217.94 feet along the common boundary line of this tract and said Lot 8 Kocurek Estates to the POINT OF BEGINNING,,, be and the same is hereby changed from "F -R" Farm -Rural District to "R -1B" One -family Dwelling District for Tract A; "A-1" Apartment House District for Tract B; and "R-2" Multiple Dwelling District for Tract C. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency -4 and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effectpfrom and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the D day of February , 19 79 .
