HomeMy WebLinkAbout14808 ORD - 02/28/1979s AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961, BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY AMENDING SECTION 31-5 BY ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5.21, SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED TRACT OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACT BEING DESCRIBED AS AN 8.6+ ACRE TRACT OF LAND OUT OF SURVEY 419, ABSTRACT 570, MADE FOR F. W. SCHAEFFER BY VIRTUE OF LAND SCRIPT NUMBER 1/1046 ISSUED BY BEATTY, SEALE AN FORWOOD, IN NUECES COUNTY, TEXAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICA- TION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendment to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at whihc hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on February 28 1979, at Special Council Meeting of the City Council in the City Council Chambers of the City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "B-4" General Business District should be granted to the tract of land hereinafter described by metes and bounds, being an 8.6+ acre tract of land, more or less. (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such con- tract contains no reference to zoning. (3) That the permanent zoning of "B-4" General Business District be granted to the 8.6+ acre tract, more or less, hereinafter more fully described. 14808 MICROFILMED rJUL 0 81980 • WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time. and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the change hereinafter set out. SECTION 2. There is hereby amended Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31-5, by adding thereto a new subsection to be numbered Section 31-5.19, said new subsection to hereafter read as follows: "Section 31-5.21 The following described tract of land shall be zoned and classified 'B-4' General Business District: Being 8.6 acres, more or less, out of Survey 419, Abstract 570, made for F. W. Schaeffer by virtue of land script number 1/1046 issued to Beatty, Seale and Forwood, in Nueces County, Texas, and being described by metes and bounds as follows: BEGINNING at SE corner of Lot 3, Riverview Estates, as shown by map recorded in Vol. 35, page 74, Map Records of Nueces County, Texas. for SW corner of this tract; THENCE with E. boundary of Lot 3, N. 34 deg. 01' E. 131.64 ft. and N. 8 deg. 32' 40" E. 623.0 feet to a one - inch iron pipe on S. boundary of Lot 5, Riverview Estates, as shown by map recorded in Vol. 34, page 115, Map Records of Nueces County, Texas, for NE corner of Lot 3 and NW corner of this tract; THENCE S. 79 deg. 11' 50" E. with S. boundary of Lot 5, 481.22 ft. to a one -inch iron pipe at SE corner of Lot 5 for NE corner of this tract on W. boundary of McKenzie Road; THENCE with W.boundary of McKenzie Road S. 9 deg. W. 624.44 ft. and S. 27 deg. 43' 30" W. 178.0 ft. to a bronze disc in concrete for N. boundary of I.H.37 for SE corner of this tract; THENCE with N. boundary of I.H. 37 N. 77 deg. 02' 30" W. 240.68 and N. 69 deg. 7' 55" W. 239.69 ft. TO PLACE OF BEGINNING. -2- SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 4. The necessity for making the aforesaid changes immedi- ately for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from an after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of l 1979.
