CAMERON, DEVELOPERS OF THE ALLEN & CAMERON INDUSTRIAL SUBDIVISION, PROVIDING FOR CITY PARTICIPATION IN THE EXTENSION AND OVERSIZE OF THE SANITARY SEWER LINE IN LEOPARD STREET, FROM CORN PRODUCTS ROAD TO SOUTHERN MINERALS ROAD, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "A"; APPROPRIATING $12,000 OUT OF THE NO. 250 SANITARY SEWER BOND FUND FOR PAYMENT TO THE ABOVE NAMED DEVELOPERS UPON COMPLETION OF CONSTRUCTION AND ACCEPTANCE BY THE CITY, APPLICABLE TO PROJECT NO. 250-77-15.5, SEDWICK TRACT, EXTEND AND OVERSIZE SANITARY SEWER LINE IN LEOPARD, CORN PRODUCTS ROAD TO SOUTHERN MINERALS ROAD; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with Gene Allen and James R. Cameron, developers of the Allen & Cameron Industrial Subdivision, providing for City participation in the extension and oversize of the sanitary sewer line in Leopard Street, from Corn Products Road to Southern Minerals Road, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated the sum of $12,000 out of the No. 250 Sanitary Sewer Bond Fund for payment to the above named developers upon completion of construction and acceptance by the City, applicable to Project No. 250-77-15.5, Sedwick Tract, Extend and Oversize Sanitary Sewer Line in Leopard, Corn Products Road to Southern Minerals Road. SECTION 3. The necessity to execute the aforesaid agreement and to appropriate the sums described in order that the orderly development of the area above described may proceed without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect from and after its passage, 14820 MICROFILMED , "JUL 0 81980 • 1 • IT IS ACCORDINGLY SO ORDAINED, this theday of March, 1979. BRUCE AYCOCK, CITY ATTORNEY By Assistant City/ MAYOR TE PUS CHRISTI, TEXAS AGREEMENT THE STATE OF TEXAS COUNTY OF NUECES This agreement is authorized by Ordinance No. and is entered into between the City of Corpus Christi, Texas ("Party of the First Part") hereinafter called "City", and Allen and Cameron, Inc. ("Party of the Second Part") being referred to as "Developer", and pertains to the City's share of the cost for improvements for sanitary sewer extensions in Leopard Street between Corn Products Road and Southern Minerals Road to serve the Sedwick Tract and areas immediately west of the Sedwick Tract. NOW, THEREFORE, the City and the Developer agree as follows: 1. The Developer will construct approximately 145 L.F. of 10" diameter sanitary sewer in steel casing to cross Leopard Street per plans prepared by Munroe & Bass, Consulting Engineers, and approved by the City, per the location shown in the attached Exhibit A. This construction will be contracted for and financed by the Developer. 2. Developer -will oversize, at his cost, the 8" line at Allen and Cameron, Industrial Subdivision to a 10" line from the north end of the Leopard Street crossing to the manhole at the lift station (Approximately 240 L.F.) shown on Exhibit A. Developer will also extend at his cost an 8" sanitary sewer line to approved City line and grade on the south side of Leopard Street westerly from the Leopard Street crossing shown in Exhibit A and referred to in Item O1 above, to serve all of Sedwick Tract and area west to S. Minerals Road. 3. The City agrees to reimburse the Developer as its share for the cost of the above stated construction, including engineering, the sum of Twelve Thousand Dollars ($12,000.00). Such reimbursement will be made by the City to the Developer upon completion and acceptance of the improvements by by the City. 4. The Developer agrees to indemnify the City against any claims arising as a result of the project. 5. This agreement shall be executed in duplicate, both of which shall be considered one instrument. When both of the duplicates have been executed by the City, and at least one duplicate has been executed by the -l- e , ,�h • Developer, this agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors and assigns.
