AN ORDINANCE
CLOSING AND ABANDONING A PORTION OF THE EXISTING
10 -FOOT WIDE UTILITY EASEMENT SITUATED ALONG THE
SOUTHERLY BOUNDARIES OF LOTS 4 AND 19, BLOCK 1,
WHELAN TRACT UNIT 2, RECORDED IN VOLUME 44, PAGES
122 AND 123, MAP RECORDS OF NUECES COUNTY, TEXAS;
PROVIDING FOR SEVERABILITY; AND DECLARING AN
EMERGENCY.

WHEREAS, there exists a certain 10 -foot utility easement situated
along the southerly boundaries of Lots 4 and 19, Block 1, Whelan Tract Unit 2,
recorded in Volume 44, Pages 122 and 123, Map Records of Nueces County, Texas,
in the City of Corpus Christi, Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon a portion of said easement:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That a portion of the 10 -foot easement situated along
the southerly boundaries of Lots 4 and 19, Block 1, Whelan Tract Unit 2, in
the City of Corpus Christi, Nueces County, Texas, as shown by map or plat
thereof recorded in Volume 44, pages 122 and 123, Map Records of Nueces County,
Texas, be and the same is hereby closed for public use and every municipal
purpose, and abandoned to the owners of the abutting property in accordance
with the laws of the State of Texas, and for the service and interest of the
inhabitants of the City of Corpus Christi, Texas, said easement being more
particularly described by metes and bounds as follows:
FIELDNOTES for the abandonment of a 10.00 foot wide utility ease-
ment adjacent to the South boundary line of Lot 19, Block 1, Whelan
Tract Unit 2, a map of which is recorded in Volume 44, Pages 122, 123,
Map Records of Nueces County, Texas:
BEGINNING at a 5/8 inch iron rod set on the West right-of-way line
of Navigation Boulevard for the common front corner of said Lot 19,
Block 1 and Lot 1, Block 1, Whelan Tract, a map of which is recorded
in Volume 44, Page 121 of said Nap Records and the Southeast corner
of this easement;
THENCE North 89°19'30" West, along the common boundary line of
Lots 19 and 1, 215.00 feet for the Southwest corner of this easement
from which corner the Southwest corner of said Lot 19, Block 1, bears
North 89°19'30" West 25.00 feet;
THENCE North 00°40'30" East 5.00 feet for an inside corner of this
easement;
THENCE North 89°19'30" West 20.00 feet for a corner of this easements

THENCE North 00°40'30" East 5.00 feet to a point on the North line
of said 10.00 foot wide utility easement for the Northwest corner of
this easement;
TRENCH South 89°19'30" East, along the North line of said 10.00
foot wide utility easement, 235.00 feet to a pointon said West right-
of-way line of Navigation Boulevard for the Northeast corner of this
easement:
THENCE South 00°40'30" West, along said West right-of-way, 10.00
feet to the POINT OF BEGINNING.
FIELDNOTES for the abandonment of a 10.00 foot wide utility
easement adjacent to the South boundary line of Lot 4, Block 1,
Whelan Tract unit 2, a_map of which is recorded in Volume 44,
Pages 122, 123, Nap Records of Nueces County, Texas:
BEGINNING at a 5/8 inch iron rod set on the East right-of-way
line of Bigh Starr Drive for the common front corner of Lots 3 and
4 of said Block 1 and- the Southwest corner of this easement;
THENCE North 00°43'00" East, along the East right-of-way line
of High Starr Drive, 10.00 feet for the Northwest corner of this
easement;
THENCE South 89°17'00" East, along the North line of this ease-
ment 172.69 feet for the Northeast corner of this easement;
THENCE South 00°40'30" West 5.00 feet for a corner of this ease-
ment;
THENCE North 89"17'00" West 17.50 feet for an inside corner of
this easement; -
THENCE South 00°43'00" West 5.00 feet to a point on the common
boundary line of said Lots 3 and 4 for the Southeast corner of this
easement from which corner the Northeast corner of said Lot 3 bears
South 89°17'00" East 25.00 feet;
THENCE North 89°17'00" West, along said common boundary line of
Lots 3 and 4- 155.20 feet to the POINT OF BEGINNING.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word
or provision hereof be given full force and effect for its purpose.
SECTION 3. The fact that the public convenience and necessity
would be better served by the closing of a portion of the aforesaid easement
creates a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be passed

finally on the date of its introduction but that such ordinance or resolution
shall be read at three several meetings of the City Council, and the Mayor
having declared such emergency and necessity to exist, having requested the
suspension of the Charter rule and that this ordinance take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED, this the day of March, 1979.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
