HomeMy WebLinkAbout14855 ORD - 04/11/1979RWC:vp:4-1Q-79:1st AN ORDINANCE CALLING A RUNOFF ELECTION FOR MAYOR AND THREE (3) COUNCIL MEMBERS IN THE CITY OF CORPUS CHRISTI, TEXAS, TO BE HELD ON THE 28TH DAY OF APRIL, 1979; DESIGNAT- ING POLLING PLACE LOCATIONS FOR SUCH ELECTION; ENACT- ING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMER— GENCY. • WHEREAS, the City Charter provides for the holding of a regular City election for Mayor and six (6) Council Members in the City of Corpus Christi, on the first Saturday in April in odd -numbered years, the same being April 7, 1979; and WHEREAS, it is provided in Article 4.06 of the Texas State Election Code that the governing bodies shall order elections pertaining to municipal affairs, give notice upon the election of officers to hold the election; and WHEREAS, Article 7.16, Texas Election Code, requires runoff elections in all cities over 200,000 to be held within thirty (30) days follow- ing the issuance of the call for the second election in the event that any candidate for Mayor or Council Member fails to receive a majority of all votes cast for such office at any regular municipal election, at which runoff election the two candidates receiving the highest number of votes for such office in the first election shall again be subject to a vote of the qualified voters; and WHEREAS, the official canvass of the election returns of the regular election duly held for the office of Mayor and Council Members has been duly had in accordance with State law and City Charter requirements, and inasmuch as none of the candidates for the office of Mayor and none of the candidates for office of Council Member in Places 1, 3, and 6 received a majority of all votes cast at the said regular election, held on April 7, 1979, for such office, there is hereby declared a necessity for a runoff election: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a runoff election for the election of Mayor and three (3) Council Members in Places 1, 3 and 6 in the City of Corpus Christi, shall be held in the City of Corpus Christi on April 28, 1979, with the names of the following candidates to appear on said ballot for the respective offices as follows: MICROFILMED 14855 JUL 08 Mo • MAYOR: Luther Jones Jason Luby COUNCIL MEMBER PLACE 1: COUNCIL MEMBER PLACE 3: COUNCIL MEMBER PLACE 6: David Diaz Francisco Rodriguez, III Tony Juarez, Jr. Betty Turner Jack Dumpily Alma Meinrath SECTION 2. That at said election herein ordered all the qualified voters of the City of Corpus Christi shall be permitted to vote. SECTION 3. That the names of candidates for the office of Mayor and the names of candidates for the office of the City Council members shall be placed on said ballot in the manner and form prescribed by law. SECTION 4. Staples 120 Woodlawn School 1110 Woodlawn • 121 Yeager School r�-5414 Tripoli • • The presiding judges shall be authorized to select such clerks or other assistants provided by law, and as may be deemed necessary, and said election shall be held in accordance with the general election laws of the State of Texas. The polls shall be open from 7:00 A.M. to 7:00 P.M. on the date of said election. Absentee voting shall be conducted by the City Secretary at his office in the lobby on the first floor of City Hall by the use of voting machines requiring personal appearance, and the results canvassed and returns made as is provided by law. For the purposes of this runoff election the office of the City Secretary is declared to specifically include that area in the City of Corpus Christi City Hall on the first floor in the lobby in front of the Building Division Information Desk and the hours for conducting such absentee voting shall be as follows, with absentee voting to commence on April 1®, 1979, or as soon thereafter as possible and extending through April 24, 1979. The hours for absentee voting shall be from 8:00 A.M. to 5:00 P.M. Monday through Friday. A special canvass board is hereby appointed as follows: Vanilla Guy Ethel L. Simmons Margie Morrill SECTION 5. By approving and signing this ordinance, the Mayor officially confirms as his action all matters recited in the ordinance which by law come within his jurisdiction. SECTION 6. The fact that it is necessary and essential that the governing body of the City of Corpus Christi shall order elections pertaining to municipal affairs and that the ordinance calling such runoff election should be promptly adopted and that a runoff election for the election of the Mayor and three (3) Council Members in the City of Corpus Christi shall be held on the 28th day of April, 1979, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance • - . • or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT I5 ACCORDINGLY SO ORDAINED, this the day of April, 1979. COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
