AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH THE CORPUS CHRISTI MUSICIANS' ASSOCIATION, INC.,
LOCAL NO. 644,FOR TWELVE CONCERT PERFORMANCES AT A
COMPENSATION OF $542 PER PERFORMANCE, NOT TO EXCEED
$6500 TOTAL, FOR THE PURPOSE OF PROVIDING MUSICAL
PERFORMANCES FOR THE BENEFIT AND ENJOYMENT OF THE
CITIZENS AND VISITORS TO CORPUS CHRISTI, ALL AS MORE
FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY
OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement with the Corpus Christi Musicians' Association, Inc.,
Local No. 644, for twelve concert performances at a compensation of $542 per
performance, not to exceed $6500 total, for the purpose of providing musical
performances for the benefit and enjoyment of the citizens and visitors to
Corpus Christi, all as more fully set forth in the agreement, a substantial
copy of which is attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. The necessity to authorize the aforesaid agreement at
the earliest practicable date creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordi-
nance or resolution shall be passed finally on the date of its introduction
but that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared such emergency and necessity
to exist, and having requested the suspension of the Charter rule and that
this ordinance be passed finally on the date of its introductioiand take
effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO ORDAINED, this the 9 day of May, 1979.

AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
That this Agreement, made and entered into on this the day
of , 1979, by and between the City of Corpus Christi, a
municipal corporation, hereinafter referred to as "CITY", and the Corpus
Christi Musicians' Association, Inc., Local No. 644, A.F. of M., of Nueces
County, Texas, hereinafter called "UNION":
WITNESSETH:
The Union has agreed to provide eleven (11) concerts to be held
in Cole Park Amphitheater on the following dates in 1979:
June 3, 10, 17, and 24; July 1, 15, 22, and 29; August 5,
12, and 19;
and one performance at the Texas Jazz Festival on July 8, 1979, for the
benefit and enjoyment of the citizens of Corpus Christi.
In consideration of providing music for these performances, the
City agrees to pay the Union the sum of Six Thousand Five Hundred Dollars
($6500). Payment up to the agreed sum is to be made on presentation of
requests for payment submitted at the end of each month at the rate of
Five Hundred Forty -Two and No/100 Dollars ($542.00) per performance held
during that month.
In addition to the concert funding, the City further agrees to
provide use of facilities for these performances through the Park and
Recreation Department.
The City further agrees to provide the transportation of music
stands and musical instruments before and after each outdoor concert.
Transportation will be between Del Mar College and the site of the eleven
(11) concerts at Cole Park.

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
