AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER
NO. 4 TO THE CONTRACT WITH M & M CONSTRUCTION COMPANY
FOR IMPROVEMENTS TO THE LOZANO SCHOOL AREA STREETS,
SAID CHANGE ORDER PROVIDING FOR RECONSTRUCTION OF BETEL
STREET FROM S.H. 286 TO BURNET STREET; APPROPRIATING
$32,822 OUT OF THE NO. 220 STREET BOND FUND, APPLICABLE
TO PROJECT NO. 220-77-2.1, LOZANO SCHOOL AREA STREET
IMPROVEMENTS; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be and he is hereby authorized
to execute Change Order No. 4 to the contract with M & M Construction Company
for improvements to the Lozano School Area Streets, said Change Order No. 4
providing for reconstruction of Betel Street from S.H. 286 to Burnet Street.
SECTION 2. That there is hereby appropriated out of the No. 220
Street Bond Fund the sum of $32,822 for the work aforesaid occasioned by
Change Order No. 4 applicable to Project No. 220-77-2.1, Lozano School Area
Street Improvements.
SECTION 3. The necessity to authorize execution of the aforesaid
Change Order and to provide the sums necessary in order to complete the
project creates a public emergency and an imperative public necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall
be passed finally on the date of its introduction but that such ordinance
or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared such emergency and necessity to exist, and
having requested the suspension of the Charter rule and that this ordinance
be passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,

II. Add 18 working days to contract for this added work.
III. Add lump sum of $3,500.00 to Contractor's payment for increased
costs of caliche, reinforced steel, wire mesh, hot -mix asphalt,
prime coat and mobilization expense due to near completion status
of project.
Why was this change necessary? (If left off the plans and specifications, explain why.)
Decided to improve Betel Street while Contractor was working in -area, rather than
wait for separate contract.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
