AN ORDINANCE
AMENDING ORDINANCE NO. 14540, PASSED AND APPROVED
BY THE CITY COUNCIL ON OCTOBER 4, 1978, WHICH AWARDED
THE CONSTRUCTION CONTRACT FOR THE ELLA BARNES UNIT 1-A
STREET IMPROVEMENTS TO ISLES CONSTRUCTION COMPANY, SO
AS TO REVISE THE APPROPRIATIONS FROM THE NO. 220 STREET
BOND FUND AND THE THIRD YEAR COMMUNITY DEVELOPMENT BLOCK
GRANT AS FOLLOWS: OF THE $770,000 APPROPRIATED FOR
CONSTRUCTION AND ASSOCIATED EXPENSES, $219,266.80 IS OUT
OF THE NO. 220 STREET BOND FUND, PROJECT NO. 220-77-2
(ELLA BARNES UNIT 1-A AREA STREET IMPROVEMENTS) AND
$550,733.20 IS OUT OF THE NO. 162 FEDERAL/STATE GRANTS
FUND, ACTIVITY 4736, CODE 502, THIRD YEAR COMMUNITY
DEVELOPMENT BLOCK GRANT APPLICABLE TO PROJECT NO. 220-77-
2.2; AND DECLARING AN EMERGENCY.

WHEREAS, by authority of Ordinance No. 14540, passed and approved
by the City Council on October 4, 1978, a contract was entered into by and
between Isles Construction Company and the City of Corpus Christi for the
purpose of awarding the construction contract for the Ella Barnes Unit 1-A
street improvements; and
WHEREAS, it is necessary to revise the appropriations from the
No. 220 Street Bond Fund and the Third Year Community Development Block Grant;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That Ordinance No. 14540, passed and approved by the
City Council on October 4, 1978, be and the same is hereby amended by revising
the appropriations from the No. 220 Street Bond Fund and the Third Year Community
Development Block Grant as follows: Of the $770,000 appropriated for con-
struction and associated expenses, $219,266.80 is out of the No. 220 Street
Bond Fund, Project No. 220-77-2 (Ella Barnes Unit 1-A Area Street Improvements)
and $550,733.20 is out of the No. 162 Federal/State Grants Fund, Activity 4736,
Code 502, Third Year Community Development Block Grant applicable to Project
No. 220-77-2.2.
SECTION 2. The necessity to immediately amend the aforesaid ordi-
nance and contract as set forth above creates a public emergency and an impera-
tive public necessity requiring the suspension of the Charter rule that no
ordinance or resolution shall be passed finally on the date of its introduction
but that such ordinance or resolution shall be read at three several meetings

of the City Council, and the Mayor having declared such emergency and necessity
to exist, and having requested the suspension of the Charter rule and that this
ordinance or resolution be passed finally on the date of its introduction and
take effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO ORDAINED, this the 9 day of May, 1979.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
