HomeMy WebLinkAbout14897 ORD - 05/09/1979• vp:5/B/79:1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT AND OPTIONS THEREIN WITH NUECES COUNTY COMMUNITY ACTION AGENCY AND COASTAL BEND LEGAL SERVICES FOR APPROXIMATELY 1,900 SQUARE FEET OF SPACE LOCATED AT 200 NORTH SIXTH STREET IN ROBSTOWN, TEXAS, FOR AN INITIAL TERM OF 13 MONTHS, FOR USE AS A TITLE VII NUTRITION PROGRAM KITCHEN AND MEAL SITE FOR THE SENIOR COMMUNITY SERVICES PROGRAM, ALL AS MORE FULLY SET FORTH IN THE LEASE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "A",'AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a lease agreement and options therein with Nueces:County Community Action Agency and Coastal Bend Legal Services for approximately 1,900 square feet of space located at 200 North Sixth Street in Robstown, Texas, for an initial term of 13 months, for use as a Title VII Nutrition Program Kitchen and Meal Site for the Senior Community Services Program, all as more fully set forth in the lease agreement, a substantial copy of which is attached hereto, marked Exhibit "A", and made a part hereof. SECTION 2. That the necessity to authorize execution of the afore- said lease agreement and options therein in order to continue the aforesaid services creates a public emergency and an imperative public necessity requir- ing the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested that such Charter rule be suspended, and ti at this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDI#9Vl,INED__EILMED this the day of May, 1979.'JUL 0i 9 ATTEST: IC ii Secretary APP OVED: DAY OF MAY, 1979: J. BRUCE AYCOCK, CITY ATTORNEY THE (V OF CORPUS CHRISTI, TEXAS 14897 • LEASE AGREEMENT THE STATE OF TEXAS COUNTY OF NUECES 1 This Lease Agreement, by and between the Nueces County Community Action Agency, and the Coastal Bend Legal Services, hereinafter referred to as the "Agency" and the City of Corpus Christi, Texas, a municipal corporation and body politic, operating under the home rule statutes of the State of Texas, hereinafter referred to as "City". WITNESSETH: WHEREAS, City desires the responsibility of establishing a Title VII Nutrition Program meal site in a section of the building known as the Nueces County Building in Robstown, Texas; and WHEREAS, said building is adaptable to adequately service the elderly population in the area; and WHEREAS, the Agency has consented to provide space in said building; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that City and Agency do enter into the following agreement: Agency agrees to lease said portion of that building known as the Nueces County Building in Robstown, Texas, located at 200 North Sixth Street, to City for an initial term, beginning May 1, 1979, and terminating June 30, 1980. After the initial term, this lease shall continue to be enforceable by parties for successive one-year terms unless notice to terminate is given by parties. City agrees to pay as consideration for said lease, the sum of $1.00, receipt of which by Agency is hereby acknowledged. Either party to this agree- ment shall have the right to terminate its obligation and responsibility herein by giving the other parties at least sixty (60) days advance written notice of such intention to terminate. II City shall occupy that section of the aforementioned building as hereinafter described: a) Assembly Room (1,197 square feet); b) room adjoin- ing Assembly Room, restrooms, adjoining hallway, pantry, and air-conditioning room (703 square feet); total square footage amounting to 1,900 square feet. • III City shall be responsible for repairs required in the Assembly Room to adapt said space to its program needs. Any other repairs required by the City in the space to be occupied by the City shall be the responsibility of the City. IV City shall conduct the principal activities of the intended program during the hours of 8:00 a.m. to 5:00 p.m. Monday through Friday each week, and at such other hours as may be scheduled by the City. During such hours the space will be under the supervision of the Director of Senior Community Services. V City shall assume the responsibility of providing all necessary furniture and/or fixtures to maintain a Title VII Nutrition Program meal site. VI City will pay a proportionate share, based on the amount of space used, of the following named utilities: electricity, gas, water, and sewer, based upon its occupancy of 1,900 square feet of space in said building. Agency will bill City for its share of utilities on a monthly basis and enclose with each billing copies of the utility bills provided by the utility companies. VII City will provide janitorial services for the area it occupies and will supply equipment and any incidental supplies needed for this maintenance. VIII Any use of the City's allocated space by the Agency will be mutually agreed upon and coordinated by the Agency's Robstown Rural Supervisors and the City's Meal Site Manager. Agency will assume responsibility for janitorial services when said space is in use by Agency. IX Agency will provide restroom facilities for use by the meal site participants and City staff; in turn, City will provide restroom supplies such as soap, paper towels and toilet tissue. -2- • x City shall indemnify and hold harmless Agency from and against any and all liability for loss, damage or injury to persons or property arising out of City's use and occupancy of the demised premises.
