AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
BETWEEN THE CITY OF CORPUS CHRISTI AND THE NUECES
COUNTY COMMUNITY ACTION AGENCY TO PROVIDE FOR THE
PAYMENT OF UTILITY BILLS FOR ELIGIBLE HOUSEHOLDS FROM
FUNDS MADE AVAILABLE FROM THE 1978 EMERGENCY ENERGY
ASSISTANCE PROGRAM (EXTENDED), IN ACCORDANCE WITH THE
TERMS OF SAID AGREEMENT, A SUBSTANTIAL COPY OF WHICH
IS ATTACHED HERETO, MARKED EXHIBIT "A" AND MADE A PART
HEREOF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement between the City of Corpus Christi and the Nueces
County Community Action Agency to provide for the payment of utility bills
for eligible households from funds made available from the 1978 EMERGENCY
ENERGY ASSISTANCE PROGRAM (EXTENDED), in accordance with the terms of said
agreement, a substantial copy of which is attached hereto, marked Exhibit "A"
and made a part hereof.
SECTION 2. The necessity to authorize execution of the aforesaid
agreement at the earliest practicable date creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date of its intro-
duction but that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared such emergency and
necessity exist, and having requested the suspension of the Charter rule and
that this ordinance be passed finally on the date of its introduction and take
effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO ORDAINED, this the %G day of May, 1979.

EMERGENCY ENERGY ASSISTANCE PROGRAM
Utility Payment Agreement
This agreement is made and entered into by and between City of Corpus Christi
, hereinafter referred to as "Company" and
Nueces County Community Action Agency, hereinafter referred to as "Organization".
The parties hereto have severally and collectively agreed and by execution hereof
are bound to the mutual obligations and to performance and accomplishment of the
task hereinafter described.
The Company agrees with respect to each case where payment to a fuel customer is
certified by Organization:
1. To reduce bills or balances outstanding as of the applicable
period of the fuel/utility customer by the full amount of the
Emergency Energy Assistance Program payment to Company by
Organization. The payment on behalf of each certified household
must be applied toward the cost of fuel/utility consumption,
excluding any late payment, interest or penalty charges.
2. For those households certified as eligible, to, ply credit
toward the cost of fuel/utility consumption prior to
July 31, 1979, in an amount no greater than that remaining
after the aforesaid reduction of outstanding bills or balances.
In the event that a credit balance remains after July 31, 1979,
the Company must return the unused balance to Organization no
later than July 31, 1979.
3. To provide to Organization two accounting reports reflecting the
amount of credit used for fuel consumption and the credit balance
remaining for each account. Said reports are due June 30, 1979
and July 31, 1979.
The Organization agrees, with respect to each case where payment is certified,
on or before the applicable period to:
1. Identify to Company those households certified by Organization
for participation in the Emergency Energy Assistance Program.
2. Pay the Company on behalf of each certified household a total
sum of not more than Two Hundred Fifty Dollars ($250.00) on
behalf of that household.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
